I am getting a bit bored of these daily battles on the Argus website. Another day, another ill-informed nimby. :nono:

I agree. Just feel that we can't let up until FPC back down.

Then it's all just hot air by Septic.....and I've got an FOI request on it's way to me from BHCC about legal costs.
 




From the Argus report:-

"Council leader Melanie Cutress first told The Argus the meeting was "confidential", but when challenged could not produce any legislation allowing councillors to expel the media from a public meeting".




The legislation is:-
Schedule 12A to the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) Order 2006.

This allows the press and public to be excluded from any part of a meeting which will discuss "Information in respect of which a claim to legal professional privilege could be maintained in legal proceedings" ... in other words, legal advice that is being provided to the council.

I suppose it's a positive step that they only told Our Fearless News Reporter to "take the hint, son". But perhaps there was an insufficiency of photographers to thump.
 








One thing I'm sure about is that the hostility that is being shown towards them - here and on the Argus site - makes an appeal MORE LIKELY.

I don't understand this. They are either going to appeal and nothing we say or do will convince them otherwise or, they have no grounds for an appeal. I can't see how a few messages on the internet is going to change things.

Or is Cuttress such a vindictive bitch?

I have got to the point now where I find reading the Argus very irritating. I used to have some sympathy for the NIMBYs but that is all gone now thanks to the inaccuracies and now total lies they come up with. What's the point of living in a democracy when people like them want their own way whatever the majority say ?

But doesn't the appeal have to have some substance? Could FPC not be declared a vexatious litigant if they're appealing purely to delay the process?

One question I've not seen covered is how they fund an action? Say it costs £250k and they lose - could this money simply be recovered by adding it to the council tax?

Actually, that's two questions: how is parish element of council tax worked out - is it the parish saying what it should be or does Lewes work out a sum and then say that's the parish tax? And are there any legal limits - could FPC (or even Lewes DC) say next year that we're raising council tax by, say, £500 this year to meet the cost of fighting Falmer or would that be ultra vires?

Just how fast and loose with taxpayers' money could FPC (and LDC) be?

I have to agree that some of the posts here on Nsc do make me feel very uncomfortable and don't forget that FPC do read this board.
They also used these posts to try and get Roz arrested for harassment because as a moderator, she didn't delete them.

I know a lot of people think I am a middle aged busybody but please be careful what you post about Falmer people.

Of course the Court can throw an appeal out. But it would take MONTHS (at least) for the Court to get around to deciding that.

As for the parish element of council tax - that is a matter for the parish council itself to decide. LDC have no say in the matter.

When The Argus again tried to enter the hall, reporter Simon Barrett's path into the public building was physically blocked by a villager who said: "Take the hint, son".

I was thinking almost exactly what you've said....If they don't like being criticised or ridiculed on here-they should piss off, this is not FPC Chat.

Some on here are talking about building bridges while they (FPC) maintain their campaign of lies and deceit and then resort to their peculiar brand of democracy: behind closed doors meetings and "take a hint" thuggery towards an Argus reporter.

I was more disturbed by some of the comments on the Argus website - however, given that anyone can post on there there is nothing to stop us suggesting that those comments are actually just another bit of NIMBY propaganda.

I know we're all annoyed about the length of time things have taken, and FPCs further fannying about. But I don't think we should flinch now, and talk of banning buns isn't helpful at a time when we need to be magnanimous in our dealings with these people.
