No. As an example and to be clear, it is illegal for your partner to wake you up with a BJ. Which is a shame.

In your hypothetical, the friend is drinking the tea themselves, you're not involved in the tea drinking. Step back and let them do whatever they want to themselves.
Ok, so how about you've made the tea, and you're about to give it to them, but you realise they're too drunk to know what they're doing - should you then withhold the tea, and say they can't have it?

I think the lesson is, somewhat, that you do have consent to make love to an unconscious person's cup of tea. But not when it is in their mouth or any other orifice.

Well why didn't they just say that, instead of wrapping it up in code.

Nope, still illegal. You can't give consent to have sex in the future. You need to be capable of giving consent at the time.

Why given that if the decision is to overturn the conviction the DPP have stated they will seek a retrial. I cant see anyone taking him on until that process has concluded and unless this second trial returns a not guilty verdict.
