However they have both broken the rule, so one club would never get a punishment and the other not.

If West Ham get a points deduction .... and that’s a huge IF then West Brom will get one as well.
It doesn’t matter WHO suggested the ‘agreement’ the fact is both clubs are as guilty as each other. You won’t get one club punished more than the other.
I’m yet to see anything from Welbeck or Lallana that gets them ahead of Maupay and Mac Allister.

Leicester look great at the moment.
But they did at the same stage last season, 39pts from 19 games.
They more than any other team are hugely dependent on one player. Even when he isn’t scoring his threat of getting in behind leaves spaces for players like Maddison to exploit.
I still think we might be interested if the deal is right.
Whilst other clubs are interested we might sit and wait to see what happens and if no one else shows their hand we might make a move.
