Correct, falsification of business records is a “misdemeanor” crime under US law. It becomes a felony crime if the falsifying is with the intent of furthering a separate crime. It’s this latter point which changed his charges from a minor to a major crime. Had there not been further intent with his book cooking he wouldn’t be a felon.
