It's possible (and I'm not saying this is what happened) that he made a mistake which caused the crash, but that that mistake was not negligent, and therefore it's not manslaughter. People do make mistakes that lead to the death of others, and it's not always manslaughter.

I don't agree. People have died, it is tragic. But the pilot is another human and deserves fair justice (and I don't know what that is in this case). If the interest of loved ones was the only concern, then perhaps the pilot would be locked up even if he didn't do anything wrong (I'm not speculating about what he did or didn't do).
