As an employer you tend not to settle if you have a cast iron case.

In my experience working for a company with 200-ish people, the directors tended to regard tribunals as a lottery that was biased in favour of "the little guy" rather than the employer. I know that we ended paying off all kinds of troublemakers, some of whom were probably guilty of criminal offences, just to get shot of them.

When I was a local journalist we used to get excited when we saw the list from the tribunal court, but every time we thought we had a juicy case to cover, a phone call to the clerk on the day of the hearing revealed that the parties had settled.

I never in a million years thought this would go to court. The club has seemed very sure of its actions all the way through and even the casual observer could see that Gus's behaviour throughout this saga has been erratic and inconsistent. I have big respect for his management qualities but not his personal conduct.

And in terms of the speculation and rumour, this is certainly not the end. We'll all be talking about this for years, simply because it's a good story. And, to a large extent, an unsolved mystery.

I feel this is a good appreciation of the position - Gus's threat of legal action was most likely a knee jerk reaction at that time (as most punters might do), and not surprising in a profession where they routinely defend the indefensible. Gus had a reputation to try to protect while in the full glare of the media. He had to be seen to appeal the dismissal within the Club's own process or he would disqualify himself from taking it to a tribunal. It is quite possible that his application to a tribunal may not even pass the preliminary stage.

The LMA as his Union would (as in other professions) predictably make very bullish statements, even in the face of the evidence when a prominent member is in a disciplinary situation. But whether Gus ever had sufficient grounds for him to expect he could win a legal case seems naïve. I don't think Tony Bloom would risk making public statements about Gus asking to leave without notice at such a crucial time if these couldn't be stood up in Court. I suspect there is much more to this that will never emerge.

I suspect it isn't the end of the story and again rather naïve of the armchair sages on here to suggest otherwise because surely there is clearly potential for at least two books giving the gory details from both parties perspectives, unless they have been legally gagged?

That is not in line with the tone and spirit of what Tony Bloom said last week at the NWSS meeting. He said there was no money in the budget for any sort of settlement or legal appeal costs.

Indeed, the Argus says there was no financial settlement, and I had not read that when I posted what I posted.

The Argus also says that the Football Club refused to comment. My reading of that is that it might be a massive climb-down from Gus and/or a realisation that he is OK where he is and pursuing this claim is just not worth the bother.

It is good to have it over with, and at least Gus had the good grace to thank the club and its supporters.

Not sure about that, maybe not today or tomorrow, but one day it will come out. Might take 10-15 years or more, but people know what happened and someone will blab before they take it to their grave. It might even help sell Tony Blooms autobiography "BHA FC Champions League Glory".

I suspect the 'settlement' referred to wasn't necessarily financial, but more that the finer details never get disclosed.

Massively curious, but then I'm also curious about how my wife might react if I surprise her one night with an escort for a 3 in a bed romp. Some very bad sh*t can happen with curiosity, it's sometimes best left unexplored.....

I doff my cap at Gus for having the grace to walk away from legal action then.

I guess having a job now that he wants to give 100% attention to has helped.

Also interesting that Bloom now stating that when Gus was here they believed they would have to cut the playing budget for this season.

We don't know what happened, but I wouldn't use standard cases as a comparison for a public case like this.

Common sense prevails. Dragging the case through an Industrial Tribunal would, I suspect, have been damaging for both parties. This is the right outcome even if the inevitable mutually binding confidentiality clauses will mean we will forever be wondering what really went on. But we need to move on too.

Yep not many people sacked for gross misconduct end up working for the BBC and then walk into a Prem job.

The gross miscuduct charges haven't been reversed and the settlement is probably Gus suddenly realising how lucky he has been and accepting that the way forward is to not look back.

Love that. 'The grace to walk away'!!!!! An alternative slant is that he has been persuaded that he hasn't a cat in hells chance of winning. Lawyers are unlikely to concede if there is a hint of a chance at winning or at least earning fees on a drawn out case!

With regard to the issue itself, I would be intrigued to know whether or not he had actually initiated any legal proceedings. If it were to be a tribunal, my understanding is that you have three months from the date of the 'detriment' to issue IT1 papers. That would have been on the 22nd September. If he had, they may well have gone to conciliation meetings! Whatever happened, I would think the fact there is no financial settlement involved would suggest a climb down by Poyet. Could be that both parties have agreed to silence but Poyet has obviously lost out more!!!

The bottom line is that it is fantastic news everything is now over.

Gus has gone, which I am very glad about, and with him dropping his case it makes eventual forgiveness easier.

His career is revived so good for him, and all the best with that.

The albion are still on an upward course - Oscar will lead us to glory, maybe even this year.

So all that remains is to thank Gus for the good times, and one day be able to welcome him back to the AMEX.
