As an employer you tend not to settle if you have a cast iron case.
In my experience working for a company with 200-ish people, the directors tended to regard tribunals as a lottery that was biased in favour of "the little guy" rather than the employer. I know that we ended paying off all kinds of troublemakers, some of whom were probably guilty of criminal offences, just to get shot of them.
When I was a local journalist we used to get excited when we saw the list from the tribunal court, but every time we thought we had a juicy case to cover, a phone call to the clerk on the day of the hearing revealed that the parties had settled.
