Assuming he pleads guilty, the point is moot. The police donāt have to tell the suspect that the witness isnāt cooperating, and heād only find this out when the defence receive their witness list discovery pre-trial.
In my opinion, there is no chance this case gets that far as itās open and close, and heāll be advised on the strength of his case and his chances at trial pretty quickly.

Yes, there are such circumstances, but we don't know if any such apply here. It certainly doesn't look good - the punch itself is bad enough, but the continued assault on the man on the ground might be a tad harder to justify; that really, really doesn't look good.With respect your second sentence says it all .
