Developers are moving into Lewes Road Community Garden this morning.

Contractors have begun arriving at the site of the former petrol station in Brighton to secure the area.

However protestors, who have been ordered to leave the site, are sitting in front of their machines blocking the way.

Police officers have just arrived at the site.

Developer Alburn Minos has planning permission to build seven flats and two retail units at the site.


Protesting against what for gawd sake? They don't own the land. Buy the land or sod off. No wonder this country's in such a state.

I was surprised they 'took' it so easy. i was expecting riots over this but then i suppose it was raining when they moved in.

It's saddening scenes. That's the corner of the street i grew up on from 11 years old onwards, and my mum was one of the creators and diggers of the community garden too. Now there'll be a Tescos competing with a Co-op next door, a Spar 20 metres away, and a big Sainsburys 200 yards off. The people of Lewes Road really needed another mini supermarket with its glum standardisation of life greyly attached and its eternal promise to offer you nothing all that special. I mean, i don't have warm memories of the Esso that once lived there, but a garden, a tiny area of unused land taken and developed by the local community off of their own backs for pretty much everyone's good should be applauded and defended by the council.

Bailiffs and police are currently at the site of Brighton's Lewes Road community garden.
The bailiffs attempted to execute a court-order to seize the garden at about 2am today.
But protesters who have made it into a community garden are reluctant to give it up to developers Alburn Minos who hope to build seven flats and two shops, one of which is set to be leased to Tesco.
In a message sent this morning to members of the Lewes Road Community Garden Project Facebook group, garden co-founder Duncan Blinkhorn said: "At 2am this morning bailiffs, with help from the police, took over the Community Garden.
"I have not ben involved or been in the garden since 28 June, so don't know the latest but I'm sure others will fill in the details. I'm told that a fence has gone up and diggers are on the site.
"Caroline Lucas is meeting with Tesco management tomorrow (Wednesday) in London to tell them that their store is not wanted on the Lewes Road.
"Owners of the land, Alburn (Retail) Ltd, are pursuing their claim against me, Ron Edwards & 'persons unknown' for thousands in legal costs prior to 28 June.
"There was a hearing scheduled at Brighton County Court tomorrow (Wed 8 Sep) at 11.30am but I've sought an adjournment as there has not been time to get legal advice. I'm putting together a series of witness statements.
"I'll let you know when the new hearing date is."
The garden's takeover has caused a stir in the neighbourhood. This morning, Fran Swaine tweeted: "Walked past the Lewes Road community park thingy this morning. It's now walled up with metal sheets, with a big lorry in it."
Inspector Paul Betts, speaking today, said: "Officers from Sussex Police are present at the community garden in Lewes Road, Brighton at the specific request of the attending bailiffs who are executing an order granted by the courts to occupy and secure the site.
"Our presence is not to carry out the eviction but to prevent any breach of the peace and to minimise any potential for disruption to the wider local community.
"As ever we will facilitate peaceful protest if it occurs and seek to ensure that no criminal offences are committed. It is important to us to maintain the trust and confidence in all communities effected by this Operation".
A previous attempt for bailiffs to seize the garden took place at the end of July this year.
The garden was originally created in May 2009 with the agreement of Alburn Minos as the gardeners promised to leave when it needed the land.
But when they learnt that Tesco planned to lease one of the units they decided to stay.

Caroline Lucas MP and campaigners challenge Tesco to pull out from the Lewes Rd Community Garden site.

Caroline joined with local Green Councillor Ian Davey, and the founder of the Lewes Rd Community Garden Cathy Marchand, in a meeting with Tesco's Corporate and Legal Affairs team this morning, to seek to persuade Tesco to review its decision to lease one of the shop units in the new development on the site.

Caroline said: "We had a very forthright and open discussion in order to explain to Tesco the strength of local feeling against their plan to open a store on the Community Garden site. It was clear that they had under-estimated the opposition, and didn't fully understand the specific circumstances of the particular area. We were very pleased that they have undertaken to review the situation, and to respond to us within two weeks."

Councillor Ian Davey, who has been involved with the garden site since its inception, said: "We really emphasized the strength of the local opposition, and the total unsuitability of the site for what they want to do. We stressed the likely impact on existing local shops in the area, and made a strong case that not only would Tesco alienate the local community if they go ahead, they would also suffer strong reputational damage themselves. We hope they will now reconsider their position."

Caroline concluded: "In its Corporate Responsibility Report, Tesco makes a strong claim about its willingness to listen to the community. It says 'We listen to people in the community from the moment we identify a site for a new store or an extension. We want to respond to suggestions and concerns people might have.'

"The test of Tesco's fine words will be whether its listens to the community in the Lewes Rd - and pulls out as a result."

I hear Tesco's have now officially pulled out of developing the site.

I wonder who will rock up and build on it now.

Hopefully it will be reserved for much needed social housing. But with Connaught going bust its unlikely.

Ikea?
