Shocking decision but the Leicester argument makes sense saves the embarrassing situation if that and also I suspect will mean there won’t be an appeal from Everton also saving the embarrassment potentially of relegation not being sorted until after the season ends.
But this is the type of situation where clubs will potentially breach the rules and say the signing of certain players or refusing to sell others to balance the books out weighs the minimal points deduction.

I'd also introduce a tariff for "frivolous appeals", being as an appeal is currently a shot-to-nothing - ie much to gain, nothing to lose. Which just serves to drag out the process and the uncertainty even longer.

If the appeal is unsuccessful and the original decision is upheld, then the club is deducted a further 2 points for appealing. That might train some minds.

In its written reasons the independent commission accepted the club's arguments for mitigation in relation to the fact the club has:

  • Already been deducted points this season
  • Loss of club revenue because of the suspension of a sponsorship deal with Russian company USM
  • An early admission of guilt
(from https://www.bbc.co.uk/sport/football/68723109)

I would assume, if it's not clearly stated in the reasons, that the 'already been deducted points' argument is in relation to the argument that with a rolling 3 year cycle, two of the years considered for this points deduction were also in the the previous cycle (rather than 'you've been deducted points once and you're ignoring that and still failing, so we won't bother punishing you too much')
Ah yes, the USM sponsorship. Totally commercial deal and not a way of getting funds into Everton outside of FFP at all.

Good analysis and conclusion 👍

But how does that fit with the fact that Man City would not if won the leagues and cups ? What’s the difference ?
This whole charade it’s just so corrupt

Sadly the teams lower down will probably not escape so lightly. Just encourages the bigger clubs to ride roughshod over the powers that be knowing nothing will really happen

Why is it not a bigger penalty for 2nd offence

Probably because it’s finance. The accounts are looked at on a 3 year basis but it’s not that easy once you have gone over, to find a ton of money to get you back into an acceptable figure.

In Everton’s case, they had a Russian investor who got sanctioned, so they lost a ton of investment - like if someone barred Bloom, we couldn’t get ourselves out of the financial mess probably for a good few seasons.

They also have been done already for some of the accounting period covered, so won’t do them twice for the same period of time.

Everton are still in the shit but they have 3 6-pointers.

They will stay up annoyingly.

Why haven't they come up with a slidding penalty for each £x million. As example 10m = 1 point, 20m = 2 point etc and onwards up to say 100m equalling 10 points, thereafter a further 1 point deducted for every 5 million with no cap.

If they are repeat offenders then the following season they start with negative points equal to what they were deducted the season before.

If club wants to opt for a fine instead it could only be done if the shareholders were fined personally and identical amount as the club itself was fined. The fine? well why not set that at as being the same amount as they overspent.

Make it so unpalatable that they maybe put off making the sin in the first place.

Oh, and no appeals and no ’mitigating’ circumstances.
But City & Chelsea plus now Newcastle could easily afford any fine. £100m+ would be peanuts to them.

Its two points to safeguard the threat of Leicester taking litigation for relegating them instead of Everton.....as this relates to league season ending 2022/23.

If it was three points Leicester would have stayed up last season. Two points and Everton would have stayed up with a better GD.....
Great conspiracy theory, but Leicester themselves are facing charges for overspend last season and the two prior to that.

Think about this.
Allegedly Man City, Chelsea & Newcastle have all broken the rules.
7 or 8 teams will qualify for Europe next season but we may finish 9th because three teams above us have overspent to get where they are.
Is that fair?
Obviously the answer is no but nothing will happen this season against the clubs with big wallets who can afford the best legal team.

People who keep bleating on about Chelsea not getting clobbered is getting tedious. Their recent billion-quid splurge is relatively recent, whilst the FFP rules of £105m losses spans over 3 years.

Rest assured Chelsea's reckoning is very much in the post, just not quite yet due to accounting periods. So in the meantime, stop mithering on about it.
OK so it’s got f*** all to do with the fact they reported themselves for the miss accounting of seasons past. They have a case to answer irrespective of their latest splurge.

Just fell asleep while driving. Had 5 live on, and some dullard came on chatting about FFP and Everton's points deduction.

They really don’t get that many clubs will accept such a minimal points deduction for cheating. They have set the bar so low that it’s hardly worth the effort of trying to manage it, especially as the bigger clubs seem to be able to defer penalties by Trump proportions.

Everton are having a party right now, whilst also pretending they're going to appeal it.

Everton have already that they plan to appeal.
