I'd also introduce a tariff for "frivolous appeals", being as an appeal is currently a shot-to-nothing - ie much to gain, nothing to lose. Which just serves to drag out the process and the uncertainty even longer.

If the appeal is unsuccessful and the original decision is upheld, then the club is deducted a further 2 points for appealing. That might train some minds.

I would assume, if it's not clearly stated in the reasons, that the 'already been deducted points' argument is in relation to the argument that with a rolling 3 year cycle, two of the years considered for this points deduction were also in the the previous cycle (rather than 'you've been deducted points once and you're ignoring that and still failing, so we won't bother punishing you too much')

Ah yes, the USM sponsorship. Totally commercial deal and not a way of getting funds into Everton outside of FFP at all.

Why is it not a bigger penalty for 2nd offence

Probably because it’s finance. The accounts are looked at on a 3 year basis but it’s not that easy once you have gone over, to find a ton of money to get you back into an acceptable figure.

In Everton’s case, they had a Russian investor who got sanctioned, so they lost a ton of investment - like if someone barred Bloom, we couldn’t get ourselves out of the financial mess probably for a good few seasons.

They also have been done already for some of the accounting period covered, so won’t do them twice for the same period of time.

Why haven't they come up with a slidding penalty for each £x million. As example 10m = 1 point, 20m = 2 point etc and onwards up to say 100m equalling 10 points, thereafter a further 1 point deducted for every 5 million with no cap.

If they are repeat offenders then the following season they start with negative points equal to what they were deducted the season before.

If club wants to opt for a fine instead it could only be done if the shareholders were fined personally and identical amount as the club itself was fined. The fine? well why not set that at as being the same amount as they overspent.

Make it so unpalatable that they maybe put off making the sin in the first place.

Oh, and no appeals and no ’mitigating’ circumstances.

But City & Chelsea plus now Newcastle could easily afford any fine. £100m+ would be peanuts to them.

Its two points to safeguard the threat of Leicester taking litigation for relegating them instead of Everton.....as this relates to league season ending 2022/23.

If it was three points Leicester would have stayed up last season. Two points and Everton would have stayed up with a better GD.....

Allegedly Man City, Chelsea & Newcastle have all broken the rules.
7 or 8 teams will qualify for Europe next season but we may finish 9th because three teams above us have overspent to get where they are.
Is that fair?
