Another Ridiculous decision by the Immigration Authorities

Two words for this country Soft Touch. What an absolute disgrace. Its these sorts of stories that I would expect our new leaders to act upon immediately and at least set an example, however as usual nothing will be done. When are these stupid laws going to be changed to stop people taking this piss out of this country.

I presume that it was an accident, so I'm not sure manslaughter would have been possible. He sentence implies that he wasn't charged (or found guilty of) driving dangerously or without due care. He was charged with not stopping at the scene of an accident and driving whilst disqualified.

Yeah, I know what your saying, but his leaving the scene contributed to her death didnt it?
Ive seen people being charged with manslaughter following deaths in fist fights...where im sure the people didnt actually intend to kill the other person...ie...the death was an accident...

Its never bloody cut and dried is it.

Ill never understand how the judiciary works anywhere...a good friend of mine was shot dead by a scumbag in The Hague and got 14 years..another turd killed 3 Irish young men in drug related thing and got a similer sentence....with good behaviour etc...they get out earlier..

Always thought, if youre sentenced to 20 years..you should do 20 years...not out in 7 or 8 etc..

Yes, because someone that runs away and leaves a 12 year old girl dying under the wheels of their illegally driven car is such a good role model and father arent they ? by that argument should we not jail murderers that are parents then ?

But that would rule out everyone on Merseyside over the age of 13.....

Completely outrageous. Has he even shown any remorse for what he did? If I was the father I daresay I'd be channelling my efforts into finding this bloke and serving up some real justice - leaving him wishing he'd opted for deportation.

Certainly, (seeing as he has no other family) i fail to see how you couldn't weigh up the consequences of serving time in return for a slow retribution. Something i hope i'd never have to do.

Two Oxford Brookes girls were killed by a van driver who had drunk the equivalent of 15 pints. They lived a couple of doors down from me. Lovely girls. The van driver himself was killed, so the selfish bastard didn't have to live with the consequences of his actions.

Sadly, I kind of feel that someone who is prepared to drink 15 pints and drive will still be able to live with the consquences.

Probably true. At the inquest, his wife said that he was a 'recovered' alcoholic, but had started drinking lightly again. I bet she regrets not doing something.

He should have been deported after his (measly) sentence.


The 33-year-old, who did not hold a driving licence, was jailed for four months for driving while disqualified and failing to stop after an accident.

On his release he met a British woman and they had two children, Harry, four, and Zara, three.

He was due to be deported but won the right to stay in the UK in December 2009 after arguing that, because he now had two children since being freed from prison, he had a right to a family life under Article 8 of the Human Rights Act.

I feel for the family of this 12 yr old, to lose her in that way and then find the person rersponsible gets away with a pathetic sentence and to top it all will be allowed to stay in this country and continue his criminal way of life,its no wonder people are
entering this country, they could never hope to be treated so well anywhere else in the world.

being from a not very nice place is the underlying criteria for a lot of asylum claims. all bolstered and given confidence in their idiocy by the views of quite a few people who havent got thousands of asylum seekers on their doorstep, but can pontificate about it with confidence in Hanover pubs.


Being a Hanover resident I can safely say I won't be one of the people who live there pontificating about asylum seekers.

I'm with everybody here, but, he has a family with two young kids (all British) and you can understand that they shouldn't be penalised for his crimes.

The error here was the pitiful sentence and the sentencing judge not ordering immediate deportation before he had the chance to meet his future wife.

Seems convenient that a 2nd child turns up during these events, be interesting to see what the DNA could show up. Wrap him up, stick him in a box and ring UPS - Job done. I'm not sure how these lawyers, judges etc sleep at night but I suppose their fee's pay for a hell of a lot of sleeping tablets !! They are all devoid of any sense of morality.

I'll just cut in here. The title says another shocking decision from the 'immigration authorities'. In fairness to UKBA (who I work for), they had moved for the offender to be deported on completion of his sentence. The decision was overturned by a special immigration tribunal. This will be comprised of members of the judiciary unrelated to and independent of UKBA. As such, UKBA has been "trumped" by the legal system in this instance.

This is fairly common. While I worked abroad a large number of my decisions were overturned by such a tribunal and some very unpleasant people have obtained visas as a consequence. It was unbelievably frustrating. I'm not suggesting that the border agency should be above the law, as all enforcement agencies need to have checks and balances applied to them. However, sometimes the decisions reached by the tribunals can seem almost willfully perverse.

This is simply political opportunism of an almost unprecedented level. The law that he is seeking to have changed is...er...The Human Rights Act 1998, introduced by Labour in 1998. The clue is in the title.

So Jack would like to change a law that his own party brought in one year after coming into office and which they then had a further 12 years to address. Presumably he was lobbying hard for a change that whole time?

Disgrace!

This is a case where the Father should then take it up as a Civil law suit and sue the guy.

Won't get any money from it but the prospect of having to be in debt to the father all his life might send him running.
