What breaches copyright? The word Brighton isn't copyrighted. They don't use the logo on the scarves and word them carefully not to use anything copyrighted (see the posts above about Premier League and Premiership for example).
Whilst I’m not 100% on the correct terminology isn’t it only people selling from stalls/vehicles that require a license and those without are hawkers/pedlars which is covered by something else?

Yep they are careful not to get done for copyright. Obviously words like Brighton or Albion aren't copyrighted but BHAFC and the seagulls logo are so they'll not use those.
And the one I always bang on about: we should move the away fans so they're not on the main camera angle. Places like Palace and Newcastle you don't see the away fans unless the camera is specifically showing them. It's a little thing but helps with the subconscious perception of those watching.
