From the supermarkets point of view you are using a parking space that on a Saturday could have genuine shoppers using it. With 2 customers every 90 minutes , spending £150 each on a trolley load , over the course of an afternoon it adds up big time.

I accept that. However I saw no signage, I saw no mention of payment anywhere. And £70 for parking for forty minutes longer than the minimum?? They're taking the piss.

AND by the way, there were loads of spaces for shoppers to park in so I didn't cost them anything.

I received a letter in the post today with pictures of my car entering and leaving Morrisons in Brentford. I parked there for our away game. Apparently there are signs saying that parking is restricted to 120 minutes for customer use ony. However neither me or my son saw any of these signs. The bastards are charging me £75 for the privilege of using their f***ing car park.

I recall seeing other Brighton fans in the car park and in fact in one picture there is someone walking by my car in their Brighton yellow and blue shirt!! Anyone else got caught by this?

MUG..................... should have gone by train .

Its not a fine, its an invoice, or in other words, an invite to offer into a contract. Contracts need to be mutually agreed.

Only a mug would pay it.

You can't help some people, jeeeeeez

They are demanding money they have NO legal right to demand.

All this boloney that you will end up with CCJ's or have to defend yourself in County Courts with a huge end bill to pay just isnt accurate.

You have been watching 'Bailiffs' on TV where councils are chasing legitimate parking fines, this aint one.

Ignore the chancers.

Sorry mate it seems to me its a fair cop. " I did not see the signs " is no defence.

Actually, when it comes to private parking enforcement it is. The signs have to be highly visable and numerous enough that the driver can not be considered to be "entraped" into the contract. One small sign in the corner of the car park will not do. I've no idea if there was sufficient signage in this case but Little Al is right - nobody should pay these fines until the government legislates against the private parking enforcement and clamping companies. Generally they are run by very nasty people and thugs. When there are legally agreed rules, an official appeals procedure and "fines" that are at a reasonable and uniform level then OK, pay up and shut up but until then the nasty little criminals that run these rackets can swivel :salute:

Indeed. It may be I was a dosey moment and didn't the signs, but I parked immediately to the left of the car park in the first space I saw and I genuinely don't remember seeing any signs. Had there been a big f*** off sign at the entrance saying no parking for more than 2 hours then I wouldn't have gone near it.

If anyone is in the area and fancies checking this out for me I would be very grateful.

I have to say Giraffe, if you contact them in any way, at any time, it invalidates my offer to pay your court fine. If you contact them, it enters you into negotiation of their shitty contract/invoice.

If you totally blank them and get an official court summons, my offer stands.

Not being funny you seem so worried about this, you should pay this 'invoice' and get on with your life.

You have been told that you needn't, but hey ho.

It remains unenforceable, but it may be that for every 'bullying' letter you receive it will effect your whole day so pay it and get on with your life.

Already you have spent minutes, hours, days mulling over this 'fine' you have no legal obligation to pay that it might of been better doing a comparable amout of overtime and you could of paid this 'penalty' and still had some money left over.

Good luck.

Well that was kind of the view I took and hence why I went to pay it last night. However the bastards had already increased the amount to £90 on the first day I received the letter (and a day earlier than the letter stated), so I thought f*** em, they are clearly trying it on so I'm just going to ignore them.

I'm not worried about it. I have Little Al's guarantee, so job done

Okay no contact.

Expect shitty official looking letters, do not respond to anything that doesn't come from a court. A court letter will have an official red stamp on it as it will be a summons. You won't get one, trust me. I have to trust you to not to contact them. You have my phone number, feel free to call me to verify I am telling the truth.

I reckon you will get 6-8 letters, then hear no further.

I asked the question about what happens if the penalty charge is ignored and was told by the car park attendant who patrols 2 supermarket car parks here that letters are sent and if these are ignored the company takes it to court. The penalty charge is also increased to reflect the additional costs of taking it to court.

The car park attendant being a minimum wage gofer who will repeat anything he is told to say. If he said "Oh don't worry mate they won't chase you for it" people would just ignore him and park all day for nothing making him fairly redundant.

I don't know how many times this has to be said but this is not a legally enforcable 'fine' it is a charge they want you to pay for allegedly breaking their car parking rules. The DRIVER of the car that is. If in the highly unlikely event that they did take it to court they would have to convince the civil claims court that the person DRIVING the car and therefore responsible for parking it there did whatever they are claiming and that their charges for this are fair. As the OWNER of the car you are under no obligation to pay or even reveal who was driving and so cannot be held liable for any charges however legitimate or official they make them appear just because you own the car.

Anybody knocking on your door demanding payment is likely to be some muscle bound black leather jacket clad baldy debt collector from an agency since for bailiffs to come a knocking would mean you will have recieved at least several court summons for payment and official court notices before genuine bailiffs turn up.

You are under no obligation to admit you parked the car there and they are not going to prove otherwise with a picture of the car parked there since that does not prove who parked it there.

Basically these companies rely on people being frightened into paying and there are enough people out there that will to make them a nice little earner. Its money for old rope isnt it, send a letter demanding £70, what does that cost? peanuts! you only need a low percentage to pay out and you are raking it in.

FFS just ignore them and if they pursue it let them prove it was you that parked there.
