The target decision date is 09/02/09 so February unless it is delayed at all then hopefully early March.

My belief is that there is a period after that date in which an appeal can be made, I think it's upto 9 weeks....hence work on the stadium wont start till April/May at the earliest...

It wasn't planned to anyway, the roads have to come first.

I'm not too clued up on this stuff :D
Strictly speaking, this item is quite separate from the question of planning permission.

What is being considered this afternoon is a report that recommends the Council to enter into a leasing agreement with the football club to allow the stadium to be built and the club to occupy the City Council's land at Falmer.

Most of the Report is "restricted" (ie not put into the public domain) - presumably because it contains confidential financial information. "Restricted" reports aren't discussed by the Council in public, so we will only be told the decision, not given access to the discussion.

The fact that the recommendation is to approve the council entering into the leasing agreement is, of course, EXCELLENT news.
 








Anyone know if the Cabinet approved the lease? Cannot see anything on the council website.

(1) That Cabinet approves the council entering into an Agreement for Lease with

the Agreement for Lease be delegated to the Director of Finance and Resources and
the Assistant Director of Finance (section 151 officer) in consultation with the Leader
of the Council.

(3) That Cabinet agrees in principle (subject to any S123 consent required) a
lease of the Stadium site to The Community Stadium Ltd on substantially the terms
set out in the Part 2 report.

(4) That Cabinet notes the decision of Policy and Resources Committee in
September 2007 that the council will support the Community Stadium scheme so far
as is consistent with not directly funding the project.

REASON FOR THE DECISION

This report seeks approval to land transactions which have been contemplated since
the principle of the new stadium at Falmer was first established. Its
recommendations are in the context of decisions taken by the council in 2003 which
formed the basis for the public inquiries and the planning permission granted by the
Secretary of State in July 2007.

DETAILS OF ANY ALTERNATIVE OPTIONS

The second public inquiry exhaustively examined alternative sites for the football
stadium and concluded that Falmer was the only suitable site.

OTHER RELEVANT MATTERS CONCERNING THE DECISION

the council against liability in the event that the agreement is determined.

(2) That Cabinet agrees that authority for confirming to the University of Brighton
that the Funding Condition in the Agreement for Lease has been satisfied be
delegated to the Director of Finance and Resources and the Assistant Director of
Finance (section 151 officer) in consultation with the Leader of the Council.

(3) That Cabinet agrees in principle (subject to any S123 consent required) a
lease of the Stadium site to The Community Stadium Ltd on substantially the terms
set out in Annex B and that authority to enter into the Lease be delegated to the
Director of Environment (advised by the Assistant Director Property and Design) in
consultation with the Cabinet Member for Enterprise, Employment and Major
Projects.

(4) That Cabinet agrees in principle the disposal to The Community Stadium Ltd
of the land shown on plan at Annex D and that agreement to the terms of the
disposal be delegated to the Director of Environment (advised by the Director of
Finance and Resources and the Assistant Director Property and Design) in
consultation with the Cabinet Member for Enterprise, Employment and Major
Projects.

What will happen WHEN FPC appeal against BHCC's granting of planning permission?
 


I've just spoken with the supervising planning officer at BHCC (M Anson) and the Falmer application (2008/02732) is scheduled for the next planning committee meeting on February 4th.
The detailed agenda etc will appear on the council's website from Thursday; planning committee meetings take place at Hove Town Hall, starting at 2pm - I think it's pay on the gate before anyone asks.
