But it's the thin end of the wedge, isn't it? If it's okay to harm them while committing the crime, what about afterwards? After all this guy was fleeing, he wasn't in the process of actually burgling the house when he was attacked. So now it's okay to attack a criminal after the event, is it?
Put it like this, if i was DPP , the chances of anyone being charged for attacking burglars during or after the burglary would be slim to none, just like the little shit who got shot in norfolk, how many houses has he gone on to burgle ?

i see. so the punishment neednt even be in proportion to the crime. beatings all round. would this also be the punishment for say car theft, or shop lifting? how about recieving stolen goods, i mean they must have known the cheap car was bent. lets dispense with the whole judicial system, it costs too much money. under bushy law you can simply give someone a good slapping. that'll fix the country in no time.

Yes it is, the guy has done a damn good job of protecting his house from future burglaries. If he'd merely run off his property he may well have been back. By chasing him down the road and beating the crapola out of the little shit, it's fair to say neither him, nor any other local hoodlum will be going anywhere near his place ... well, not once he gets out anyway.

There has to be a bigger deterrent to stop these burglars. With prison an absolute breeze the upside of burglary is huge, while the downside is modest.

Not really looking for an argument as I am tending to agree with you for once.

What I mean is that if you are allowed to give someone a slap for breaking into your property, will it extend to breaking into your car or to someone who rapes your missus? If you allow it for just burglarly the legal reprocussions will snowball into vigilantism for a number of different offences.

i know what you mean , and obviously there are boundaries, i just think there could be more discretion used in these cases .

If it had been in the States the burglar would have been shot and the case would probably not even get to court. Not saying I agree with that – seems too extreme in the States and too soft in the UK.

after he'd tied up my family and robbed my house , go on , what do think my answer to that question is going to be ?

My answer to this is that I would probably only give him a slap. However if I caught him mid burglary with my wife and children tied up then he would get both barrels without question.

but why are you stopping there? isnt car theft an invasion of my property? or are only burglars deserving of a good kicking? does dull old theft or mugging go in to bushy beating law or stay outside? If someone is assualted outside their home, does the aggressor escape a beating? how do you deal with dodgy builders who've worked on your home, when the work goes wrong do you go round for a good shoeing? you're mis-sold a pension/loan/electricity suppy deal by a saleman, can you go and give him a slap?
