If the police do find no case to answer how can the FA take any action and if they do would it be justified.

Probably due to the fact that the Barnsley manager had blood coming from the injuries he received in the tunnel area. There is also a different level of proof between criminal and FA proceedings.
The only certainty is that the FA will take no action until the Police or the Courts have concluded their involvement in the incident
