my bloody neighbours again fecking bastards
they had some work done in their bathroom leaving a hole on the outside where the waste pipe was and sure enough a blue tit decided to make a nest there, this weekend the neighbours have had their decking covered with tables and chairs and I knew it would happen they noticed the little female going in and out presumably feeding fledglings or sitting on eggs.
next thing is he is cementing the hole up. I asked him not to for the reasons above and the answer was "so what"
this developed into a full fledged row with him offering me physical violence which I gladly excepted but his wife (jackboot Janice) stood between us to stop him stabbing me with a bricklayers trowel (lol)
they really don't like animals killing half the fish in my pond, threatening my cats and swinging boots at the local stray, now this.
god I am so angry
they are a disgrace to the human race

Definition of a wild bird
Under the Wildlife and Countryside Act, a wild bird is defined as any bird of a species that is resident in or is a visitor to the European Territory of any member state in a wild state.

Game birds however are not included in this definition (except for limited parts of the Act). They are covered by the Game Acts, which fully protect them during the close season.

Basic protection
All birds, their nests and eggs are protected by law and it is thus an offence, with certain exceptions (see Exceptions), to:

•intentionally kill, injure or take any wild bird
•intentionally take, damage or destroy the nest of any wild bird whilst it is in use or being built
•intentionally take or destroy the egg of any wild bird
•have in one's possession or control any wild bird, dead or alive, or any part of a wild bird, which has been taken in contravention of the Act or the Protection of Birds Act 1954
•have in one's possession or control any egg or part of an egg which has been taken in contravention of the Act or the Protection of Birds Act 1954
•use traps or similar items to kill, injure or take wild birds
•have in one's possession or control any bird of a species occurring on Schedule 4 of the Act unless registered, and in most cases ringed, in accordance with the Secretary of State's regulations (see Schedules)
•intentionally or recklessly disturb any wild bird listed on Schedule 1 while it is nest building, or at a nest containing eggs or young, or disturb the dependent young of such a bird.

Fines
The maximum penalty that can be imposed for an offence under the Wildlife and Countryside Act - in respect of a single bird, nest or egg - is a fine of up to £5,000, and/or six months' imprisonment.

What can I do?

Not Glasfryn. I think he relates better to animals than he does to humans.

Don't get involved having massive arguments with the neighbours because you're legally obliged to disclose any disputes when you sell your property.

It's a grey area though and there's nothing stipulated exactly what level of dispute you have to disclose. I'm not sure there is any actual legal enforcement of this rather you would have a strong civil case in the event you found out a major issue was not disclosed. On my last move I had the scummiest chavviest shite family from Moulscoomb moved in next door by the local council. I was having constant rows with the spineless idle **** next door and didn't disclose f*** all, easy solution was I just sold up to another scummy family and I'm sure they are all getting along fine now!

You're not doing a great job on selling the neighbourhood.

:)

we have given this some thought even if it was for a short time and will still go ahead with this ...we both would fight to our dying breathe for any animal to able to live without people like this abusing them.
we all have to live on this earth.
if and it is an if it gets to court we will investigate getting some recompense for any difference in the price we eventually sell for if that is possible?
I have a large bag of allsorts thrown at our cats, stones, darts, glass, slate, tiles, but you try telling the police,RSPCA they do nothing I have even caught them doing it but you lose confidence in the authorities to do anything.
I have lived all over the UK had numerous neighbours all creeds and nationalities and always managed to get along with all of them these two have lauded it over everyone who has lived here in the last 25 years even the woman the other side has moved away and abandoned here house because of their bullying, problem is when ever anyone comes up to have a go (police) she starts her soft singy songy welsh voice "ooh I'm teacher I would'nt do something like that" and the police mugs that they are believe her.
the last people that lived here had so many complaints made to the council about them by her the lady stopped counting at 20......see there is no coordination between them and the police and when I complained to the RSPCA them either.

hence the reason why we want to move

if you report it quickly they will hopefully still be alive (the birds, not the neighbours)

The purchaser can sue for compensation if neighbourly disputes are not disclosed.
