I've just won an auction but the seller is refusing to sell the item at the winning bid.Basicailly she is giving me rubbish that her pc crashed and she couldn't pull out.Is there nothing can be done about it apart from neg feed back?

Surely it is a binding contract? I would email ebay (resolutions department?) and ask for their guidance. I can't see how she would wriggle out of this one, but then I have only studied about 5% of common law.

I won the item for £16 but she wanted £25 for it.I offered her what she wanted as i do want that item.Can't be bothered to wait for ages for something i like to appear again.Wrong i know but i would rather have the item and she has excepted.I think you are right though Paul, i could have taking it further as it is a binding contract.

It is a civil matter, not a criminal one. If you wish to take it to court, you could, but obviously in this case you wont.

If it has gone for much less than she had anticipated, you can argue that she has to sell it, and so can Ebay. But, at the end of the day, if she does not want to sell it, she is under no obligation to sell.

Anyway, it isn't worth the hassle :thumbsup:

If it has gone for much less than she had anticipated, you can argue that she has to sell it, and so can Ebay. But, at the end of the day, if she does not want to sell it, she is under no obligation to sell.

Anyway, it isn't worth the hassle :thumbsup:

She should have put a reserve on the item when she set up the auction. But not much you can do, she should sell it at the lower price really, seeing as the difference is only £9, And it was her mistake.
