No. He can't possibly afford the insurance to be driving his own car legally (unless he's a footballer, of course, in which case it's probably in his contract not to smoke anyway!)

Correct, the law does not apply to e-cigarettes or convertible cars with the roof down.This is explicitly mentioned in the new law, and it is still legal for the 17 year old to smoke if no one else in the vehicle is under 18.
And incidentally it is still legal to smoke in a convertible with the top fully down ( sun roofs being open don't count ! )
