Can a 17 year old , Smoke in his own car if he is alone??

They were talking about this on the radio today. A 17 year old can legally smoke if he is on his own in the car. If while driving he stops to pick up his mum struggling home with the shopping and then continues to smoke and he gets stopped. His mum gets a fine for letting him smoke, as a parent she is obliged to protect him from harming himself. And he also gets a fine for smoking because there are now 2 people in the car, one of which is under 18, even though it's him.
