Staying in the customs union would be a betrayal, agreeing to a new customs union where we were unable to negotiate our own trade deals and have to sign up to full regulatory compliance .. the same. A customs arrangement limiting barriers to trading with the EU where we were free to make our own trade deals and had the ultimate say on what regulatory alignment was appropriate would be acceptable and as far as I can see that is where we are heading.
Obviously, the usual extremist suspects on both sides will present this as no change and a betrayal.

Depends what you mean by the ultimate say on what regulatory alignment is appropriate, we kind of have that now, we can, as a sovereign nation, leave the EU and do what we like. In future I think we may have a vote as to whether we agree or not, just that if we disagree we break the terms of the customs union, and sanctions will be applied till we resolve the issue, and whilst we might have it so we can make our own trade deals, they will be made so as to comply with EU rules, i.e. if we do a deal with the US, it will exclude imports of product that would not pass EU borders.
If this is what you mean, then no.
If you mean we will end up in a situation where we are unfettered by any agreement with the EU as to what type of deals we can do for ourselves, yes, I will give you a tenner.
That pesky EU are now wanting us to stick to the deal that we agreed at the very last minute on Dec 8th in order to bring phase 1 to completion. They just don't negotiate fairly

And as the the Ireland/NI backstop condition comes up again, I don't even think an Ulloa penalty special will give us more than 4 weeks in the ever shortening grass.

It was a fudge to move to the next phase, the 'phase one' backstop section can only come into force if the phase two, three, four agreements are settled. Parts of the later agreements will obviously supercede phase one backstop option as both HM government and the opposition have said it's not a realistic option.

Does anybody know the release date for the new technology that will enable the frictionless border in Ireland and the management of customs checks at the Channel ports?
It must be coming out any day now because we're leaving in just under 11 months. Maybe I've missed something?
Well after 2 years of waiting to find out what it was we voted for, maybe we won't have to wait too much longer.
I guess in a few weeks we'll know whether the phase 1 agreement was a 'fudge to move to the next phase' and a 'technology' solution has been found for Ireland/NI.
A few more weeks and we'll also know whether we are in 'a customs union', how and if we are going to introduce immigration controls, what EU legislation and directives we will abide by and what EU bodies we are going to stay in.
But even if we stay in a customs union, don't introduce immigration controls and are subservient to all EU legislation and directives, Ppf will be right and we'll be leaving the EU, so that's the main thing
it's taken you 2 years to realise what we voted for Chuckles ................. PRICELESS !
