Not it the central Lib Dem party have instructed them not to pursue the case. Even though they are the planning authority, I don't think that FPC necessarily need them. Parish Councils have proceeded and won cases in the past.


This is what their sabre rattling is meant to do.Get us upset and worried.I am not concered this is like a game of chess.We have just taken the queen and the pawns are saying they can still win.

I agree that the Government wont back down..........but all FPC( and until now LDC) want to do, is delay the process. A request for a Judicial Review will probably put the stadium back another year, and despite the Club saying that we will not go broke during this time, it will become increasingly more difficult to retain the present hardcore of 5,000 supporters, or indeed to attract new supporters for the future.

I'm not sure of the actual details here but if FPC do appeal and it is without the planning council , then it can be classed as vexatious. I think the judge can ask for the money to be paid up front?
I'm sure someone said that the Withdean lot tried that and backed down when asked to do the same.

Hopefully ROSM or Lord B can elaborate?

The lawyer they are hiring is the same one as the one that briefed LDC. Presumably the same one that advised LDC that resistance is futile (I like that phrase).

He couldn't find anything for moneybags LDC. Is he gonna find anything for poor little FPC/Downsmen and sad, sad Sue who lives in a shoe with all her children in Mile Oak?

Er... if they are going to the same lawyer who advised LDC then he or she will give them the same advice - forget it!

FPC have to show their people that they tried, they need to save face. the same as in any argument.

But if LDC say no appeal then FPC will say the same.
I hope you are right.

Still after so many hitches I can't help but worry.

I doubt it too.

The legal case for challenging the decision is one thing - and LDC are still insisting (rightly or wrongly) that the decision is flawed. However, they also have to consider the political implications as well.

Unfortunately, Falmer Parish Council don't - not to the same degree.

"We want to see if there is a chance of going to the High Court and we are also consulting the Campaign to Protect Rural England and South Downs Campaign to see if there is a possibility of forming a consortium."

I expect Mr Burt might be somewhat disappointed to know that Chris Todd, Campaigns Officer for the South Downs Campaign, has already made his position very clear:-

"I personally accept the decision even if I feel it is the wrong one".

Sorry, but pissed as I am, news from the Hartington, is that the Cutress family have accepted the decision, and will not put in any funding to fight the present decision.
