I find it incredulous the wishes and desires of tens of thousands of local people can be disregarded by half a dozen little Englanders in someone's front room, true madness.

FPC have refused to speak to the Argus ever since they ran a campaign backing the stadium... small minded NIMBYism at it's worse. They then complained that they don't have a platform to put their point across; of course you don't you stupid idiots if you refuse to speak to the local newspaper!:jester:

Why do you call them Little Englanders? What makes you think they are anti-imperialists?

You could call them Little Brightonians if you like - or Little Albioners.
 








As it happens, the law does allow Falmer Parish Council to discuss in private any legal advice they receive.


That Legal advice should be presented to them before the meeting.

I'm a little uneasy about FPC desire for a legal challenge. Any solicitor will take on a case, however unwinnable it might be (they getpaid nonetheless). But this has never been about winning, as the argument was won long ago.

This is all about delaying. Delaying in the hope that at some stage a change in political fortunes comes about. They know that if its referred back to a Labour Govt, then the same outcome will prevail. But what happens if Gordon Brown calls a snap election in say October or April and loses. Then the political landscape may change and a different decision might be made. I know all hypothetical, but it must be at the backs of FPC minds. I suspect that they have the money for this.

Lets pray Gordon Brown rules out any election until 2009 or at least stays popular

I don't. And even if they did, they have to be prepared to lose it, and the Withdean residents, of whom there are a great deal more, decided against it. I fully expect the Falmer residents to decide against appealing too.

But would they? I asked the question the other day (and no-one has yet answered) what would happen if FPC lost and just refused to pay the costs? You can't wind up a parish council and individual councillors can't be responsible for debts. Would FPC have to pay costs up front - which would stop them dead - or could they take the chance knowing that they might never be hit for costs?

Wasn,t there a case of the councillors in a london Borough that got sued and one of them (Lady ...?) was almost made bankrupt, owing millions...?

I'm sure they would have to lodge the funds for an appeal first. Either that or there must be some sort of legal sanction against those who refuse to pay. Otherwise every council who went to court would never pay up.
