It's illegal to have a 'penalty clause' under English contract law.

Construction contracts include 'liquidated and ascertained damages' (LAD's)
which are a pre-determined and agreed level of costs, generally on a weekly basis, for a delay to the contract and payable by the contractor if there is a delay to the contract period for which the contractor is to blame.

This amount is then included in sub-contracts so that if the s/c defaults time-wise the main contractor can, in turn, recover the costs from the sub-contractor.
