According to this website Kazenga LuaLua - Player profile - transfermarkt.co.uk his contract expires at the end of the season.
Of course, he would only be available free, if Newcastle were not to offer the same terms or an improved deal. Otherwise the two clubs would have to decide on a transfer fee, going to the tribunal if no fee can be agreed.

I'd be DELIGHTED if we signed him permanently. He is capable of producing magic that I have never before seen at this Club. He would be our X Factor. Granted he can't play 90 mins week in week out, but providing we don't break the bank for him he could be the player that turns a good team into something really special. McDons last week was case in point. If we had Lua Lua to come on when they went down to 10 men, I think we would have crusied to a 1-3 win. We NEED him.

He did have a few hammy problems when he was with us. I remember he pulled up against Brentford at Withdean last season, as I'd pre-warned my Brentford-supporting mate that Lua Lua would tear his fullback a new arsehole - which he'd proceeded to do for 20 minutes until his hamstring twanged, and that was the last we saw of him for a month or so. Players with such explosive pace do seem more susceptible to that kind of injury (look at Owen).
He'd still be MORE than worth the risk though I think.

Even if he is out of contract that doesn't mean we'd get him for nothing. As due to his age we'd still have to agree a fee with Newcastle or go to tribunal.

I believe as suggested here, although his contract expires he is too young to fall into the Bosman rulings and would be classed like Barry/Standing as part of club development so would require a fee to be decided by clubs or tribunal.
