The evidence being given seems to be portraying a totally different scenario to the first trial. Odd.

I didn't think they could mention the previous trial either, but they have:

Sonia Woodley QC: "You looked at the thumb nails and then clicked on ten of the images. What you said in the last trial was you were looking at each of these photographs in a matter of seconds, you just glances at them. So how did you remember, in that disorientated state you were in, what you saw and who was doing what?

Interesting. The thing is, they should be able to refer to evidence that was given in the first trial. If someone made something up (hypothetical, either side) and was cross examined and proved to be lying, the other side would want to bring that up again, otherwise the first trial just acts as a trial run (no pun intended) to get your story straight.

Victim told friend about the alleged incident on a train to London and told her she had lied to the polcie.

She said: "Because they were footballers and I didn't quite know how to tell the police who they were."

The friend tells the court she and the alleged victim drank ten to 15 shots in the Madame Geisha nightclub and shared a bottle of rose wine in Coalition nightclub on the night in question.

Friend: "On a scale of one to ten, about a five."

Mr Barton CPS: "And how was the victim?"

Friend: "She was the same."

Mark Cotter, defending George Barker, said taht in a statement to the police in February last year she had said the pair might have drunk ten to 15 shots each.

Asked if the statement was a more accurate reflection of memories of the night in question, the friend agreed.

Friend tells court that the victim was flirting and kissing a tall boy with curly hair in Coalition nightclub before she left to go to a different nightclub, Lola Lo, where the alleged victim met with Albion players.

On the Saturday morning, the alleged victim told work her father had been in a car accident and therefore couldn't come to work.

Work had left messages on her phone, but got no reply.

When she came in on Monday, her boss said: "She was not her usual self. She usually takes great care in her appearance, but she turned up in tracksuit bottoms, big jumper and no make-up or what was her old make up looking tired, stressed and upset."

In Janruary 2012 the alleged victim spoke to her boss and told her she had lied before about the details of the attack, and that the attack involved footballers.

Her boss said: "She was uspet but felt angry we were questioning her about before, are you telling the truth this time and did she know how serious these allegations were."

Mark Cotter QC, defending George Barker, asked the boss about the alleged victim's disciplinary problems.

She confirmed a fewincidents regarding incorrectly using customers' bank cards, inappropriate uniform such as forgetting her name badge and not having her hair up and an incident with lost property.

This from a little earlier made me smile!

Mr O'Neill QC: "You had in summer, autumn and winter of 2011 and interest in Brighton and Hove Albion footballers didn't you?"

Victim: "No I didn't."

Mr O'Neill QC said the victim pursued three footballers in six months.

Victim: "It wasn't because they were footballers, I would have liked someone more business-orientated."

Whats going on with this case, it seems to have gone very quiet?

It's still on going, the trial was adjourned on Friday and wasn't due to restart again until this morning. The trial hasn't been starting until 11am(ish) most days and The Argus haven't put their normal live coverage up as yet so there might be a delay.

No proceedings yesterday as juror was ill. Another couple of interesting snippets today:

10:42am

Brian O'Neill, representing Lewis Dunk, said the victim gave a detailed description to DC Lezinsky about an attack in July 2011 of five men who had attacked her in the street.

The account gave detailed descriptions of the attackers including their build, skin colour, heights, brand of clothing they wore and three names: Sam, Ben and Jack.

10:43am

O'Neill: "You were given a bit of a run around by the victim?

DC Lezinsky: "It was very difficult to get hold of her."

10:48am

Richard Barton, prosecuting, regarding the initial description of the attackers: "Is it right that the descriptions given for the men were 19 and 20 years of age, all of them fit, young males and that one of them owned a Blackberry Bold white mobile phone?"

DC Lezinsky: "Yes."

11:08am

O'Neill explained to the court that DC Valder Davis said to the victim's mother on March 21 that the case was not straightforward and the Crown Prosecution Service would have to consider the evidence with some care because the victim was unconscious or asleep throughout the alleged incident.

On April 7, DC Valder Davis received a second call from the mother saying the victim had recalled some memory of what had happened on the night in question.

Brian O'Neill told the court that in interview Lewis Dunk had been asked to explain who he had phoned from his mobile phone in the hotel room on the night in question.

O'Neill said unfortunately the police had overlooked investigating Dunk's phone records, which showed he had indeed called Rhian Connolly, a cheerleader at the club, for 35 minutes.

She was mentioned as such last time; they actually had her take the stand to give evidence.

So they went through with forensic investigation of their phones for pics and videos but failed to do something as simple as checking phone records to see if consistent with the accused's story. Nice work.
