Will Bournemouth be expelled from League 2 tomorrow ?

The FL were supposed to announce a decision on whether Bournemouth will be allowed to compete in League 2 this season. As per usual there was no news from Football League HQ or the club even though the deadline passed at 5pm today. There are unresolved questions about AFC Bournemouth being able to complete all the fixtures and the lodging of a bond. It maybe the final straw if the club are given a hefty points deduction similar to Rotherham and the FL expel them to avoid a fiasco mid season. That would mean a division with only 23 clubs and a further debate about the relegation spots , will it be one or two clubs that go down at the end of the season ?

Just read on SSN that they have had 17 points deducted for the start of the season.

Bournemouth have until 12 o'clock midday on Friday to sign an agreement with the League that they accept the points deduction and cannot appeal the decision at any point in the future. If they dont sign the paperwork in time then they will be expelled.

How can that be legal?

I guess the League has rules of membership to ensure the season doesn't turn into a fiasco by virtue of clubs failing to fulfil fixtures. It sounds like a fair reason, like any competiton, surely?

Bournemouth, Rotherham and Luton haven't abided by those rules: thus, they pay the price.

The alternative is expulsion, what would you rather have, putting yourself in their position??

Neither did Dirty Leeds abide by the rules last season when they appealed But the FL let them get away with it. They should have had more points docked

True...but I bet you AFCB, Luton and the Chuckle Brothers FC accept the punishment with a good deal more grace than some clubs did...
 






These points deductions are ridiculous. They distort the competitions that we, the fans, pay to see.

A better punishment needs to be found ... Clubs found to be in breach of the rules should simply be added to the list of clubs to relegated at the end of the season. For 2008/09, that would mean that all clubs in League Two would start with the same number of points (zero) and at the end of the season the bottom two would be relegated, along with Bournemouth, Luton and Rotherham. They would be replaced next year by the top FIVE in the Conference premier.

I agree with both your points but this situation seems likely to occur everytime a club seeks to exit administration until, and unless, the FL changes its rules on either requiring a CVA and/or preferential creditors.
If a club has an agreed CVA then, as far as the FL is concerned, it can exit administration with no points deduction and (in Bournemouth's case) start playing in FL2 on Saturday.
That sounds OK but the FL rules also require all football related debts to be settled in full before any other creditors get a penny. This is additional to the requirements of business insolvency law and has led in every recent case to the HRMC voting down proposed CVA's because other creditors are getting priority over them - what a surprise that is and exactly what I'd do!
So the poor clubs have to apply to the FL for a "special circumstances" exemption and during consideration the FL says: that'll be OK but we'll duduct you 15/17/20 points because you haven't got a CVA; sign here of you're out and btw there's no appeal.
Such a complete crock of s**t.

and as i understand it, mawhinney and his bunch of cronies are giving the line that - "you voted for this" and are treating it as an acceptance rather than a single situation (because just about everyone wanted one over on bates - prob not so much as b'muff, luton etc - rotherham were in leeds' corner from the beginning)

it is unfortunate that at a time when the rule book book could have and should have been updated/changed to reflect this CVA situation (it is going to happen every single time a club goes into admin from now on, no exceptions) mawhinney got his turkeys to vote for christmas. some of them never realised that not everyone gets a present on christmas morning.

good luck to them.

the rule book needs updating. leeds (bradford and rotherham, not sure who else) brought this fact to the summer meeting in portugal but mawhinney overshadowed the affair with his "there is no financial crisis in football" bollocks.

the whole thing is a joke. it will be a joke until the day mawhinney bogs off and allows someone forward thinking to take over his mantle, someone who will alter the rule book (with fmv of course) and provide consistent punishments for misdemeanour's but at the same time not backing people into corners with antiquated rulings that are impossible to adhere to.

On a more serious note, I reckon that rather than automatic demotion or massive points deductions why cant the FL introduce a Handicap system whereby they start every game 2 goals down...At least it gives the fans something to watch.

Reading threads like this makes me all the more appreciative about having DK at our helm.

BRIGHTON & HOVE ALBION are a club that, thanks to sensible financial control, have enjoyed success without overspending and paying the consequences like all these other clubs have.

I feel sorry for the fans (except maybe Leeds)

Dick Knight will not put the club into admin as that is how that **** Archer got hold of the club. DK is proper blue and white to the core and like you reading what has happened to various clubs the last few years it makes you appreciate the brilliant job all the board and shareholders have done since the new regime was formed

One of the other reasons they were also deducted points is that they have both been in administration recently along with this one. In Bournemouths case they were also declared insolvent. So IMHO they haven't learnt their lessons from previous financial misdemeanours, hence the punishments were more severe than they would have been if they were first timers.
