It was on Invictus, which I think was set up as a Philadelphia based rival to Tamla Motown.

Invictus was set up by Holland/Dozier/Holland when the fell out with Berry Gordy at Motown. Also on that label were Chairmen of the Board, who sang soul classics 'Give Me Just A Little More Time', and 'Everything's Tuesday'.

Pete Ham and Tom Evans were the songwriters of the group Badfinger. They were both due to take their long-suffering girlfriends out for an evening, when Evans appeared at Ham's door with a great tune in his head and needed help with it. Ham, who had another tune in his head but wanted to use it another day, initially said no, but his girlfriend, exasperated told him to go ahead - go to the studio. 'You're smiling, but there's sorrow in your eyes'.

Using their separate tunes, Ham & Evans went on to write 'Without You'. The song was first recorded in 1970 and was a commercial flop. Harry Nilsson picked the song up 18 months later, with piano and orchestra (the original was on guitar), and re-recorded it. It became a worldwide smash - No1 in the UK and USA.

However, over the coming years, the pair did not receive due royalties, and after years of wrangling, Pete Ham committed suicide by hanging himself in his garage. The rest of Badfinger were left to rue his suicide, and so tragic did they find this that, still with unpaid royalties, Tom Evans too hanged himself in his own garage exactly eight years later.

The records company's main gripe was that they claimed Ham/Evans were claiming money which the other two members of the band were also entitled to - despite the fact that neither of them were making any claims. They both admitted then - and now - that Ham & Evans wrote the song and that the royalties should be theirs.

The record company eventually paid up in the late 90s after years of going through the courts. Nilsson himself died in 1994.

But the biggest tragedy of all was... Mariah Carey's version. f***ing awful beyond redemption.

i was on the verge of crying with sadness until i read the line about mariah carey.....brilliant!:clap2:
