I have a question, though - were you an 'abstract comedy genius' before the accident, or not?

Good luck. It's clearly a big call, and no doubt really stressful to be in a situation like this that's well outside of your - and most people's experience.

You sir, are quite a remarkable individual. I have no idea as to whether you should or should not accept. I have never been through anything as traumatic as the accident you describe. If I may venture to suggest though, from reading your posts on here and the humility and ability to accept your condition you demonstrate, I would be reluctant to concur with you that you are deficient in any way at all.

You must, I guess, feel that part of you has been taken away, but with all the obvious talents, strength of character and beautiful style of writing I suspect that regardless of any sum provided to you, you will continue to be an extraordinary person, with abilities that no amount of money can or will provide.

To make others feel humble, to reflect on their own good fortune and make people think twice about their own situation through the gift of the written word is something that will always set you apart from the mediocrity around you.

A remarkable chap. The very best of luck to you.

Agree with all of this. Been reading NSC for a decade now in a few guises and MB is far and away my favourite poster. Good luck with everything.

Without being critical of the poster whose wife is a claims adjuster (presumably Aviva at Worthing!!) you cannot threaten court action against the MIB as they were not the party that caused the injuries.

To be fair to my wife, she misread the OP and thought MB was dealing with an insurance company without realising he was dealing with the MIB, by the time someone had pointed it out in another post she was just about to climb into bed, she wanted to get back on NSC to correct herself, but i told her not to worry as someone had already pointed it out. So sorry for any confusion.

By the way, she works for a company a lot bigger than Aviva.

MB sorry to hear about this, Pleased to hear it coming to an end though when a fiesta attempted to remove my leg it took me 5/6 years to finally get a settlement and that was as you said in your original post less than the solicitor told me to expect, Not to mention the countless people who know someone who got a nasty bruise and got a million so you should get at least 2 etc.

When it came to it they offered me £25k which I rejected they came back and forth and I after about 8weeks of letters settled on £40k with my solicitors fees (circa £10k) had to be paid by the insurer still thats £15k extra. So perhaps it might be worth rejecting the first offer ultimately though accept what you feel is fair.

It felt good to finally have the injury (well initail trauma) and the operations x 12 various outpatients and specialists all behind me, Settling kind of drew a line underneath it for me and I hope it does you too when you feel the offer is appropriate. Dont except less than you feel you might deserve as you'll regret it otherwise.

No harm done whatsoever. Thank her for her advice. It's all interesting stuff whether completely suitable for me or not.

That's fair enough. As for Aviva, took a punt that being in Sompting it might be the office at the grove lodge roundabout.

I think Aviva shut those offices some years ago, It would make her life easier if she did work there though as she commutes into London every day.

Thought i would give a tiny update.
I am a generally lazy person, or someone who quite often likes to sit still. It could be cowardice or a general disinterest in activity. Who knows. Anyway, the deadline for my decision of whether to accept the Motor Insurance Bureau's offer was approaching, and i hadn't said anything to my solicitor. Perhaps she thought i was playing a game of chess chicken and was unaware of my next move. Really, i was going to accept the offer and move on with life. I had an email from her saying: we're getting nowhere nearer a decision, so i have thought of bringing in a barrister i know well to advise whether you should legally challenge the offer.
I was puzzled by this for a second, but then thought a why the hell not and went for it. The advice was given and i, apparently, told the MIB that i thought i deserved more money for being injured; a statement i find rather ugly but possibly necessary then. They replied and said they wanted to see what i disagreed with and why i thought my injuries warranted £180k. The solicitor sent them the reasoning, and back they came offering my £170k instead. So, with an agreed 15% reduction for not wearing a cycling helmet, which i was but don't want to argue about it, and then probably 20% pay-out to the solicitor, i would end up with £112.2k, i think. So, about £30k more than i was first offered, which isn't bad. The MIB have said they will contribute to legal costs, so i have to find out how much they mean, making it possibly a larger sum to take home with me, but i would be quite satisfied with such an amount as it is. It's crazy money. The only other thing that is being checked is whether the MIB will allow me to claim if i develop epilepsy in later life obviously thanks to rather serious cerebral damage. They say nay, but the solicitor says we might need to challenge them slightly on that.
Anyway, that's that really. You get run over. You got horribly hurt for a period. And then get money for it. Strange.

Good to hear of the next outcome Meades Ball. I was going to offer my 2 cents when reading through this thread but seeing the likely outcome I don't think its necessary and you've been given more than enough to chew on!

Anyway, that's that really. You get run over. You got horribly hurt for a period. And then get money for it. Strange.

Yes it is strange, but people have had the foresight to put in place a system to help people in your situation and its difficult to put any kind of figure on it especially when they are asking it to be funded by the insurance industry.

Purely for interest / comparison, in my country there is no negotiation we have a set index of a lump sum according to your impairment rating (AMA impairment guidelines) and I'd say you would not get anywhere near that figure (although it would not include lost income).

An odd thing that happened when we introduced legislation for compensation many years ago, a man heard his mate had got 20k for losing his foot. He presented to a local branch after chopping off his own foot, asking if he could get his 20k too. Staff had to point out the first thing he should be doing is going to hospital before he dies. You set up a system and its very hard to cater to all and expect all the outcomes!
