Re reading it again, it just seems West Ham will rent it if they rebid, and the funding to convert will be done by the OLPC instead of a loan to West Ham, so i think the hammers win here

This is probably the best move for everyone. The stadium will remain in public ownership and be used for athletics. In addition to this paying tenant should pay the costs so that the stadium doesn't lie idle and a pointless strain on the public purse.

I wonder if they will revert to removing the top tier after the games as originally planned - surely Saracens would be interested in a 25,000 duel-use stadium. It is certainly better than the 15,000 duel-use, plastic pitched stadium they are looking at moving to.

Seems both parties get what they want ie a) a legacy for the Stadium and b) WHU get a new ground but as tenants rather than owners.

Presumably this deal would appear to make Spurs' issue about WHU receiving funding from the local authority to buy the stadium dead.

Cheaper deal in the short term for WHU and some adjustments will be made for footie but the stadium will remain configured for athletics.

Legally i dont think they would be allowed 2, now they wont have to invest any more in converting the stadium and just rent it, ok they wont own there ground but financially they will be better of, the only issue i could see it getting a loan.

Absolute commercial suicide for West Ham if they rent it.
It'll also have a crap view. The closest seat behind the goal is currently 40m away. The furthest seat in WSU is only about 55m away from the pitch.
