I'm assuming from the above that you have info from someone at the club?

As to the first bit, Poyet was unable start his job at Sunderland until legal proceedings were out of the way with BHA. No more or less mysterious than that.

Maybe Poyet was advised by his lawyers that he had no chance of winning a case against the club, and so better to withdraw legal proceedings?

I don't have any info from someone at the club. What I have stated is in the public domain. Do you to be making the claims you are? More likely you're just letting your pro-Poyet bias get the better of you - again.

Don't see that as any indication of the strength of either sides case - the club didn't receive ANY compensation either.

Erm, where is the precedent for a club to receive compensation after they sack a manager?! Clubs get compensation for managers when they allow an under-contract manager to leave for another team and agree a compensation package with that team (not the manager). In this instance there was no need to allow Poyet to leave for another team because he no longer worked for us, and as such, he was free to do as he wished.

This wasn't a simple case of a club sacking a manager for poor performance or whatever but claiming that the manager breached his contract by behaving in a manner that amounted to gross misconduct. As such the club were perfectly entitled to demand compliance with the contract in terms of compensation.

Easy to ask for a precedent - I can't think of another case dealt with in the same way as the GP dismissal was.

Suspend him for misuse of work email or something.

Surely he's looked at some smut on his work smartphone at some point?

And find yourself in court again for a probably justified constructive dismissal claim? Why not!

I have had a conversation in the comparatively recent past with a senior partner in a law-firm in Southampton who specialises in employment law who confirmed that the Seagulls/Poyet case was absolutely ground-breaking, and was the first time a club had ever tried to "do it properly". He was saying it with some admiration.

there are a lot of people on here who know dick all about employment law. equally there are a lot of people who know dick all about how football managers are employed and 'sacked'.

of course the Finn can be 'sacked'. there is a legal way to do it without compensation (a la Poyet) or there is the 'you are relieved of your duties and here is a wedge of cash to shut you up - please sign here' way (nearly every other football manager).

i can only hope that Bloom is waiting for a trigger in the Finn's contract (i.e. in the bottom 3 at xmas) so he can sack him without compo.

There are also a lot of people who know 'dick all' about using capital letters after full stops.

Most managers that are "sacked" are not really sacked like you or I would be.
Micky Adams, Russel Slade, Mark McGhee were all payed off part or all their remaining contracts.

High up on the South Downs.
I can't understand how an intelligent man like Tony Bloom could be so impressed by Sami Hyypia at an interview. Surely someone like Chris Powell would have come across as brighter and more dynamic.

Bloom's made it far more difficult for himself to cut his losses with his statement in the Argus on 12th November that 'he expects the Finn to be at the club "for many years to come"'

http://www.theargus.co.uk/sport/11595001.Tony_Bloom__Sami_Hyypia_is_here_to_stay/

Will the chairman risk an embarrassing U-turn that calls his judgement into question? Sincerely hope so, for his own sake as much as anyone's.

how often do we see a manager binned soon after a vote of confidence from the club owner? often enough to joke when it occurs that they're off. so i dont think its any more difficult and only mildly embarrassing. playing in league 1 will be more difficult and embarrassing.

For sure. But, rightly or wrongly, we tend to have far more faith in our owner, and maybe higher expectations, seeing as how he's patently a fan same as us. Plus he appears to be a highly shrewd and successful non-bonkers businessman, so not inclined to pratfalls.

Bloom will not sack Hyypia even if he takes the club down to league one. We can rant amd rave all we want no change is going to happen.

Then Tony is a fool, which he isn't.

Even allowing for the relatively long-drawn-out process of Poyet's dismissal, I'm struck by the contrast between the rush to get rid of one of the best managers in our history and the patience being shown to one of the worst (going purely by results).

How do you know that. Always amazes me that people speak with such conviction on things. Is it a way of making people think that you are "in the know".
