Correct. Unless Biden and Harris are impeached leaving the leader of the lower house next in line who can then install a VP, Have you noticed the GOP are now arguing a lot over who should be leader in the lower house/Speaker?
Actually ‘impeachment’ doesn’t mean removal from Office, it just means a request ( that needs to start in the House) to call the ‘accused’ to appear before a Senate impeachment hearing- it is the Senate that must then vote whether to proceed with a formal conviction of High Treason,Bribery or other high Crimes and Misdemeanours.

Hardly likely a Democrat controlled Senate is going to vote to criminally charge its own VP or Democratic President 🙄

It’s also incredibly serious, much more than simply equivalent to a VONC in the UK for instance. It’d be extremely worrying if either party were trying to bring down a presidency and gerrymander their own leader in through undemocratic means simply for the crime of them being from the other party.

Yes absolutely but if we are talking about the Reps impeaching Biden and Harris (which some Reps are postulating there are grounds to) you’re talking about ‘election deniers’ and the party that sat by while their President preached insurrection and dog whistled his supporters into storming the Capitol to overturn the legitimate results of a Presidential Election !!

Indeed. I’ve not followed it closely, what is it they’re trying to actually get Biden on?

Habitual being-a-Democrat.

You don't need more than that. The "high crimes and misdemeanors" in the Constitution are nowhere codified or stipulated.
Essentially they are whatever a transient majority of the lower house says they are.

Congress' research arm did a thorough study of the process, in UK and US history, while the House was drafting articles on Nixon's impeachment in 1974.
Discussions of subsequent impeachments (Clinton's, Trump's) have started here.

Raoul Berger's Impeachment, the Constitutional Problems from the same era, thought the second edition is post-Clinton, remains the usual scholarly go-to.

The impeachment momentum comes from the MAGA base (actually a majority of Republican voters) who want a Republican controlled House to file articles of impeachment against Biden challenging the legitimacy of his Presidency- Yes, Rex is correct in part, the motives are political and there is no evidence to suggest the Senate would remove Biden on any criminal grounds but this is all a direct corollary of election denial which is the core position of the GOP now.

Trump and his supporters want retribution and if they win the House, it could get messy - Trump still has enormous influence in the Party and the next Speaker of the House is likely to be one of his closer allies, Kevin McCarthy although he will himself be needing to unite the Republican Representatives. Ultimately they will attempt to drag Biden through the Senate, (Harris too for not implementing the 25th to remove Biden!) and prior to that months of impeachment resolutions going through the House to be voted on and passed to the Senate causing enormous disruption to Biden’s legislative agenda.

The main articles the Republicans will hope to draft (because the illegitimacy argument will not have much fuel) will likely focus on Biden’s Son, Hunter and his drug use, his position as a rather unqualified board member of a Ukrainian gas company and allegations of tax crimes. It’s how they will try and connect Biden to that and try and prove some kind of wrongdoing by the President which will be the issue. There are several other articles but mainly policy decisions made by Biden that the Reps did not like.

Payback is a bitch.

They can be impeached by the house of representatives but surely not kicked out if the Senate has a Democrat majority ?

Pretty sure the impeached person gets kicked out if they're convincted for whatever they was impeached for.

Yes they would but the issue is why would a democrat Senate convict them on "trumped" up charges ?

Trump was impeached twice wasn't he ? Never got kicked out.

The trial is supposed to be impartial and so 2/3rds needed to remove the president should be possible if obviously guilty.

It has been very worrying - ever since the Republicans started using this as a strategy during the Clinton years. They have been at it ever since.

So it all turned out like projected.

Dems control the Senate, Rep. control the House.
Well it’s still only a projection as more races are being counted but the Republicans have reached the 218 needed so have it sewn up, mathematically the Dems cant win a majority now - (The media generally don’t make projections of overall results until it’s in the bag and enough votes are in.)

In theory 😉

Yes true, but if for example Biden was shown running around with a bloodied axe chopping people up and you were a Democrat in a marginal then yes there is pressure on you and with a split senate getting 8 to flip is not to far a possibility as your cynical response implies.:) Also a lot of DNC want Biden gone before 2024. It would require more than the conspiracy and smear aimed at Trump(Which is why he was cleared).

This may begin to play out in Brazil where the Supreme court cleared Lula of corruption along party lines and those judges are now facing empeachment from the new Government. As a Brazillian I know said to me this level of institutional conflict can spill onto the streets and quicker than some assume.
