Rapist asylum seeker due damages

A failed asylum seeker convicted of raping a 13-year-old girl is to be awarded damages after a judge ruled he was unlawfully detained in prison.

The 31-year-old, known as "A" for legal reasons, was held for 20 months after serving his sentence while authorities tried to deport him to Somalia.

A High Court judge ruled his detention became unlawful because of its length, and he was entitled to compensation.

Human rights lawyers said he could get up to £50,000 from the Home Office.

'Misleading statements'

Mr Justice Calvert Smith, sitting in London, said the detention became unlawful because of its length, the impossibility of achieving removal and misleading statements for immigration officials.

He also said there had been a failure to consider releasing the man with an electronic tag, an option available since July 2005.

The judge said although "A" had been desperate to remain in the UK, that was not enough to displace the illegality of his detention.

He added that it was not necessary for the man to stay in the UK while damages were assessed.

But it is thought "A" may seek a further judicial review against attempts to deport him.

Media requests that the man should be identified given his criminal record were rejected.

The judge said naming him could hamper Home Office attempts to deport him.

"A" first arrived in the UK in May 1995.

He completed an eight-year prison sentence more than three years ago, for the rape of a young girl at knifepoint.

Quite right too, he only raped a young girl at knifepoint, it's not like he did anything REALLY bad, like selling fruit in pounds and ounces or something.

This is the sort of f***ed up joined up pathetic system that we seem to have these days, but hey I am sure the Liberal wing of NSC will justify it somehow.

So lets get this straight, he comes here, tries to claim asylum, rapes a child and gets £50,000.

What the f*** stops us from just putting him on a plane back to where he came from ? It really is that simple.

What world do these judges live in? I DISPAIR at times, I really do.

P.S. As a resullt of this case, I think all asylum seekers should be told to get out of this country. And people who talk funny. And anyone with COFFEE coloured skin. Clearly the BNP have got it absolutely spot on yet again. These kinds of injustices would never happen if they ran the country, I promise you that.

if he was illegally incarcerated beyond his sentence then he is entitled to compensation

the sort of mob rule or totalitarianism that would result from the wishes of NSC's illilberal wing is more worrying than this latest demonstration of how a civilised criminal justice system should operate

Unfortunately you can't blame the judge. He was convicted of rape and served his time. This cannot then effect his case for assylum. The Home Office should have deported him pronto on his release from prison. 20 months to deport him is ludicrous!! He should have been on the next boat due to his criminal record, no questions! I blame the Home Office.

How on EARTH does this piece of arse gravy get to have appeal after appeal - and on Legal Aid no doubt. Surely to goodness any vaguely common sense policy would make it quite plain than certain criminal records mean someone gets IMMEDIATELY deported, as there is less than zero chance of them ever being allowed to have residency in this country.

The rights of fecking criminals so outweighs those the victims these days, that people become desperate, and either take the law into their own hands or turn to the likes of the BNP, and it's all done out of sheer desperation.

What this guy done was completley and undoubtedly wrong yes, but people seem to be making a big deal out of the fact that this guy is an asylum seeker. What is the diference between an English person raping a girl and a failed asylum seeker? They are both equally as bad.

Im sure there are bad things that go on like this alot of the time unfortunatley. I wonder why the people are making a bigger deal than usual out of this? Mmm?:glare:

I dont dissagree that he perhaps should have been sent back whilst he was awiating trial.
