So what is the extra level of burden of proof you would introduce for the death penalty?

How could any free and fair society support the use of murder to punish those that have murdered somebody? An evil crime yes, but murdering someone for murdering someone isn't right.

We have to make prisons places of rehabilitation, allowing those to gain luxuries / privilege by doing the right thing and not allowing "luxuries" to those that don't. We have to take the claim culture out of prisons and stop this waste of public money, and use the money to train and equip prisoners to not reoffend.

But then you're creating tiers of guilt. If I was doing life but was not deemed to be proven guilty enough for the death penalty, then I'd question how I'm guilty enough to be in prison.

Tiers re levels of crime and tiers re level of punishment. Don't see why there have to be tiers of guilt?

its not tiers of guilt but a reflection of the severity, heinousness of the crime. we already do this, one burglar gets community service, another gets 5 years, another might get 15.

That's not what is being discussed though. It's this idea of "I'd introduce it but only for people that are definitely guilty".
