I know we don't even want to think about it but it is still a possibility.
Realistically what are the chances of Ruth Kelly re-opening the inquiry rather than giving a straight Yes/No decision?

Any ideas? Lord B?

How would i know?I'm pissed.
Surely there would have to be NEW evidence to force a 3rd enquiry.........???

What could a third inquiry cover that the other two have not? It would be a complete wate of everyones time and money. Nuclear powerstations have less trouble than this football stadium!

If I was a betting man (which it should be said I am) I would wager Ruth Kelly will approve Falmer but what Lewes DC do is anyone's guess in terms of legal challenges.

...I hope they make Ruth Kelly the Minister for Defence in the cabinet shake up, she can then press the button and remove Lewes from the map completely, no need for a third enquiry, QED.

All sides, especially the government, have made it plain that they do not want the Public Inquiry re-opened - even Lewes DC have told her that. Ruth Kelly will work her hardest to ensure that scenario does not happen.

Similarly, it appears no-one against the stadium has put up a strong enough case to counter John Prescott's earlier decision. Although it was quashed, and therefore invalid in the legal sense, the bases for his reasons for approving it in the first place ARE still valid. Brighton & Hove City Council has sought to clarify its position on the 'built-up area' clause which has caused so much grief, and I believe it can be ticked off as 'dealth with'.

We won't know until July 9, so I'll not worry about it until then, at which point I'll break open the Andrex. Meanwhile, I'll contemplate re-growing my beard. Or not.

What's my speculation going to be worth?

TLO has, as usual, got it right. I would concur with his view that "no-one against the stadium has put up a strong enough case to counter John Prescott's earlier decision".

I'm all the more confident, because I've been able to read the representations of the other parties. The best they can come up with is to repeat the arguments that Prescott has already considered and given little weight to. As my signature says, that's the Secretary of State's prerogative.

More evidence (and a third Inquiry) won't make any difference. It all comes down to judging what matters most - the regeneration arguments or the protection of a degraded piece of land that was once considered worthy of special landscape designation.

this is re-assuring, however , Do you think LDC will def appeal , if so , how long does that take and if their appeal then gets heard and refused.....Is that it ? we can start building ?

With Neighbour, Pepper and Commin no longer on the council, LDC's main advocates for a further appeal are in no position to push their case to the extreme. No doubt the new Councillor Cutress would like to, but she may not have enough allies to support her.

Grow a beard - its the way forward.

O and my bit on Falmer - utter rumour - Falmer station has already requested the upgrade needed for the new ground.
