Assume you wander on the train on Sunday and a fight breaks out between fans, the police arrive think you were involved and arrest you, your DNA will be taken. If you are later released you try and get that DNA removed from the database.... No chance. Whether you're innocent or guilty, you my friend are now guilty.

I don't think thats true anymore....

You can have your DNA removed if you're not charged.

I stand corrected, this one went under my radar, they are destroying them at the moment although I note from the home office that it took a new law, as Europe told us to do it a couple of years back and we ignored them. A small step forward methinks

Whilst I fully understand where you're coming from, I'd be interested to know if this applies to all types of offences, or just relatively minor ones?

Not forgetting he challenged the council every year that it was illegal for BHA to continuing playing at withdean whilst the planning saga went on and on...Waste of tax payers money on many things im sure, including Withdean. Unnecessarily so. Could have been a very different Sunday this weekend if he'd had his way. That's 25k local people's enjoyment every fortnight he tried to prevent with his selfish actions IMO, so I won't miss the old clown....which is another word beginning with C! People abuse democracy all the time. Might have rights but it doesn't make them right!

Good point Edna

There seem to be a few levels, serious and not so and they still retain DNA for various periods of time depending on what you were arrested for, see below

http://www.homeoffice.gov.uk/police/national-dna-database/pofa-2012-dna-fingerprint-prov/

The summary is that they arrest you, match your DNA to the database and then destroy it eventually depending on whether the arrest was serious or not.. Still a lot better than it was.

I've often wondered about how easy it is to find out what information about me and my (non-criminal) activities is held on a police database and whether it is possible to ask for a copy.

I shared a few beers with John Catt, and find him very interesting. He's very methodical in his views and won't be bullied about by the establishment. We need people like him to stand up for people's rights. I've seen him at the Amex Stadium and he loves it, like us all. 88 years old hero to me.

He was monitored and registered because he was at a SmashEDO demo.

I walked past the last SmashEDO demo at Wild Park. I saw John Catt there sitting on the ground with a sketchbook on his knee drawing a picture of the protest. That's scarcely an offence that justifies police capturing his details.

I say good for him. He may have been a nuisance for the Albion but he's in the right here.

I was just curious, as it's not that hard to envisage somebody being arrested for (say) a sexual offence, not being charged or convicted due to a lack of evidence, and then having their DNA removed from the database. Meanwhile, his offending escalates, and he goes on over the years to rape several other people, knowing his DNA won't be on the system to be matched unless he gets arrested again for something else. The media would go nuts if something like that came to light.

I assume something like that scenario would be covered by this legislation.

Edna According to the website that persons DNA would be on record for 3 years plus a 2 year extension. So this sex pest would have to sit with his legs crossed for 5 years

Your supposition is that we are all guilty and could all go on to offend. Liberty is in danger because of this type of thinking, that said I am so against the old DNA collection but I feel having read this its about right.

He was monitored and registered because he was at a SmashEDO demo. I'll agree with you about civil liberties but I struggle to have any sympathy with anyone who abuses the legal aid system.

He may have been a nob about the Albion - that was about council officers dotted 'i's and crossing 't's.

But I could not call a fight for civil liberties a waste of the legal aid system (that would imply civil liberties are only for the rich) - he won. If anyone was wasting money, it was the police, who couldn't adequately justify their policy.

Good on him in this instance.

Couldn't have put it better. (Except I would have said "knob" rather than "nob"!)

Not to me I'm afraid. I'm afraid - rightly or wrongly - the Withdean stuff has blinded me to anything else related to him.

You mean he's been to the Amex? He's probably collecting evidence for some other hair-brained legal challenge. I'd have given instructions to the stewards to throw him out and to make sure he bounced as they did so, 88 years old or not!

Screaming J.......I made a mistake, after seeing his picture in the Argus, it's not the John I know. I know another old feller that's always protesting. So I made a bit of a cock of myself with that comment. Whoops :)
