He has requested the phone records but has not got them yet. Magistrate asks why not done quickly - he says he does not have authority.
Prosecutor then reads an article from Sarie magazine with Botha gave to prosecution last night, which states that OP has a house in Italy and spends 4 months of the year there. Inspector is then excused - no questions about pending charges against him.

Defence now doing final arguments - basically saying that Botha agreed yesterday that the evidence so far does not contradict OP's evidence, should not be a schedule 6, poor investigative work and evidence means OP should get bail. OP is crying again, by the way.

I'm not on the ball today! First reading of this and I read 'Original Poster' every time I saw OP. I was thinking that Wozza was getting a bit too involved in this trial!

Call me strange if you want but, if I was Oscar in his version of what happened I would have got my gun, took the safety off and found a nice position behind a doorway, assumed a comfortable position and lined the gun up on the bathroom door. then I would have said something like " Who is in the Bathroom ? come out, I am armed " ( Insert pun here ). When my girlfriend answered I'd put the gun away quickly and say " only joking ".
You're far too normal.

Unbelievable, how on earth did the police department manage to assign a detective to this high profile case who in turn is also subject to an attempted murder charge! Honestly, even Kommandant van Heerden was not that stupid!!!

You would think that Botha would be suspended from the SA police service while 7 attempted murder charges hung over his head wouldn't you???

But, oh no instead, he is the leading investigator of South Africa's police biggest criminal case since Nelson Mandela's original trial :wozza:

Re why the policeman didn't have shoe covers on - so what? Oscar is not suggesting someone else came in and shot her, so what difference does it make.

Oscar says he went to the toilet door, and without knowing who was in there he shot 4 times, killing the person inside.
Police say they can't find any evidence to refute this.
So? Even assuming that is the truth, it hardly makes him innocent does it.

I hope that all the correct foresnics have been done before the body was handed over. One of the key answers to innocence or guilt is angle of bullet wounds on her body.

The thing is their (SA Police Force) credibility looks in utter tatters already and this is just the Prelims. It doesn't take Einstein to work out that OP is going to be able to get the best defence lawyers money can by and the police/prosecution story needs to be tighter than Arsene Wengers wallet.

I mean it is Keystone Cops so far..

I don't disagree. Roux is about the best you can get as a defence lawyer.

The 7 attempted murder charges relate to one incident - the case was dropped last year but has been reinstated and no-one has said so far when this was and why.
The "test" business is just a joke.

Thankfully though, OP is not disputing that he shot her. So it is going to come down to forensics, phone records and any other witnesses that come forward re fights etc that would contradict what OP says. There is some logic in his story, although it is still implausible.

Court has just been suddenly adjourned - some threat outside or something.

But yes, the prosecutor will be all over the cops on this case now and they had better not f*** it up. If no other reason, it does not show SA in a good light at all particularly when they are trying to extradite Dewani.

You must never contaminate a crime scene, it is just basic fundemental stuff, it is junior cop work. What if there were footprints/imprints of Oscar prostetics with miniscule amounts of blood on the floor (proving the story one or the other) that have now been smeared by the dog sh1t that was on Botha's size 10's.

Without a shadow of doubt OP would go to jail in the UK for what he did, but in some states in the USA if you kill someone in your own house while they are robbing you that is not a crime (I believe) I am not sure of the situ in SA.

Roux has finished summing up. The only thing he has not refuted is OP threats to "F*** someone up" at Kayalami - apparently people in their 20's do this all the time. Other than that there is nothing in state's case that contradicts OP's statement. Magistrate asked Roux if he thought there would be public shock if OP was released on bail - Roux replied that there would shock if he was NOT released. Not sure I agree with that!

So he has done well, but prosecutor must now reiterate the absurdity of the nature of this crime and then magistrate will rule on bail.

OP is still crying a lot - maybe 'cos pretty much all his sponsors have dumped him now.

Why are you saying (sarcastically) the defence will accept that? I was just agreeing with you that they need to have got all the evidence from Reeva before she was cremated.

From his own explanation, I don't see how it can be anything less than manslaughter, though the definition of that seems to be a pretty grey area.
