So if it is a genuine mistake there are no mitigating circumstances and they're found guilty as charged ?
Doesn't matter if it's a mistake or not. You can find many examples of firms falling foul of the ASA because they haven't included the VAT in some of their adverts - The Hilton and Holiday Inn hotel chains being two. In all cases afaik they all changed their adverts when the mistake (lets be generous and say it was unintentional) was pointed out to them, none of them tried the "So? It's covered by the small print." excuse

See post #175 , where does it say this price is exclusive to home fans ? Fans from other clubs check out the official sites for snippets of information regarding ticket pricing and travel directions etc.

If we're missing you point PTB, perhaps you're not explaining it properly. You have stated that it is not possible to get a ticket for £25 and it has been explained to you that you can in 2 different ways. Being sarcastic because you don't like the answer does not make you right.

So all the club has to do is hold its hands up to the mistake and change it , which will probably happen before any action is taken because the ASA has received complaints.

I mentioned 2 scenarios where the price is £25 , one pretty obscure and another perfectly feasible.

If you're a platinum member you've already paid for the privilege of being able to buy a ticket for £25. Therefore you can't buy a ticket for £25.

And if the club has seriously advertised the prices in this way in order to allow away fans to buy tickets at a lower price than that available to home fans, why? Why not maximise revenue by charging them £26 too?

My point is simply that booking fees are insidious and underhand, a fact that is backed up by the ASA rulings. It's genuinely disappointing that the club has decided to go down this route.

Well that would be the honest approach, but unlike with not showing VAT where the issue is cut and dried the club may try and claim that it IS possible to only pay £25 using the two examples you've quoted previously. God knows what criteria the ASA would use then. However their motto is "Legal. Decent. Honest. Truthful." and they may decide that the club has observed the letter of the regulations if not the spirit.

Actually I think you've hit upon something there. Not everyone has to pay VAT either.

No, because 1) an away ticket isn't available to purchase from the club. They are therefore not selling those tickets. You cannot by an away fan ticket from the club.

2) A platinum member is already an ST holder. The only occasion these individual match day prices will apply will be cup home games. If we were to only have away cup fixtures, then even a platinum member would not have purchased a ticket at the individual match day price.

There is no upfront cost to be a platinum member , hypothetically a STH in the North Stand would pay £25 for a Category C cup game.

Like I say above, if we have no cup home fixtures, then no one has been able to buy a match day ticket at the advertised price from the club.

But you cannot buy away tickets through BHAFC who are the entity advertising the price if £25 which is misleading as in actual fact it's at least £26 as there is a mandatory booking fee, I'm waiting to hear what the ASA have to say on the matter.

Can you buy tickets for the away end directly from the club? - if not then the argument regarding the prices away fans pay is nothing to do with the BHAFC advertised prices.

Using the argument that platinum members can buy a ticket for £25 as an argument for justifying the claim that tickets are available for "as little as £25" is as spurious as trying to justify a claim that tickets are available for free because 1901 members don't pay for cup tickets, or indeed for match tickets, they just pay their membership fees.

The club would argue that a £25 ticket can cost £25 regardless of it happening in reality. Home and Away ticket prices have to be the same for comparable areas of the stadium (Football League rule 34.2.8) so £25 tickets would be sent to the away club to sell at £25 if they have no booking fee and are happy just to take a 5% commission.
