sorry, but that's not what I'm talking about. If you have contents insurance there should be a section that covers you if you are sued for injury or damage caused by your negligence. Probably with a limit of £1,000,000 or £2,000,000. It's the same type of cover that you have under your motor insurance if you cause an accident. Will be known as either Occupiers Liability or Personal Liability cover. The Legal expenses cover relates to claims you may make against someone either arising out of their negligence or contractually

• If your injury was caused by someone’s negligence you must start court proceedings within 3 years of when you were injured. If you were not aware of the injury initially you have to start proceedings within 3 years of finding out about the injury.

• If the claim concerns a child who has been injured time limits do not normally start until they are 18 years old.

That's right. In other words, in 21 years time, you could recieve a summons from the kid or his representatives. Keep hold of your policy documents!!!!!

Thanks for all the comments. I do have legal cover in my contents insurance so I am inclined to tell the bitch to sue away. Her precious kittle darling wasn't that injured anyway. Seems the gash was caused by the seem on the pool. She wants to sue Argos too.

Now I know I have cover I think I might have some fun with this and wind the bitch up a bit.

By the way as she was looking after her child my thoughts are she was in charge so is negligible. I think counter sue for costs is definitely gonna be worth it for the wind up.

My wife will speak to her tomorrow to find out what she intends doing.

If it's the seam that caused the injury then she should sue Argos as she is more likely to have some luck there. With regard to your costs, there is no point counter suing. As mentioned, if she writes a letter holding you responsible, just get it to your insurers pdq. They will either defend the claim or settle. Either way, your legal defence costs are covered by the policy. If your talking about other costs, not sure what these could be.

My wife invited over one of my sons friends and his mum to play in our paddling pool this afternoon. Said friend managed to gash open his leg whilst jumping in the paddling pool under the supervision of his mother. She is now threatening to sue us.

Nice friends eh? Anyway what is NSCs opinion. Does she have any case?

Give her something to moan about. Rape her.

Surely providing the paddling pool was not already damaged in some way (ie it was considered 'fit for purpose') then she hasn't got a leg to stand on as regards sueing you, as you have not been negligent in any way shape or form. She MIGHT have more of a case against Argos I suppose.

Has the product got a Kitemark printed on it anywhere from the British Standards ? You know, one of these

If so, I think she'll be struggling big time to sue you, as its a product that has been tested and proved to be safe, so unless it was damaged, and that damage is what caused the injury, I reckon she's STUFFED.
