If it was a private firm ignore it.

I was speaking to a private firm the other day. They have over 500 unpaid parking tickets. They have taken 10 people to court, to test the waters as such. They have so far got 100% success rate.

Whats the difference ??? and do they both cover "Brighton & Hove" ? if so how do they differ in durestriction (spell) and duties ?.
The similarity is that they are both highway authorities, ESCC for the part of the Woodingdean - Falmer road that is in their area (ie most of it) and BHCC for their bit (within the city boundary - ie up near the Downs Hotel and a few hundred yards north of the old Sunblest Bakery site).

Each highway authority makes its own traffic and parking regulatory orders (but only in their own area). Each highway authority contracts out the enforcement of parking restrictions - but they are different contracts. These parking restrictions are legally enforceable, but can be appealed against - but to different offices.

I suspect the stretch of road where this alleged offence occurred is in East Sussex (because you can't see the stadium from the B&H bit). ESCC parking tickets include an address in Lewes where appeals can be lodged. ESCC banned stopping and parking on their stretch of the Woodingdean - Falmer road by means of an Order that came into effect shortly after the beginning of the season.

my wife got a ticket in waitrose car park in burgess hill, from a private firm. She had a valid parking voucher that she paid for. She wrote to them and sent a copy of the voucher but they insisted that she owes them £80 and are going to send it to a debt collector. Anyone got any ideas?

Isn't this carpark a Mid Sussex District Council facility? It's a pay and display so if she overstayed the time she paid for then she would owe the carpark owner - the council you'd think - some money but you said she had a valid ticket so presumably she hadn't overstayed. I'd call the council in Haywards Heath and depending on what they say ring up the Mid Sussex Times and BBC Sussex.

It is a SCAM. Private 'tickets' are ALWAYS a SCAM, not a real PCN, not a fine, not a penalty. Just a con, pure and simple.

She was pretty badly-advised to write to them and tell them she was driving but flippin' heckl there's enough info out there to tell you that she can safely ignore any private ticket. Don't you dare pay, it would be like paying a phishing emailer for a foreign 'lottery win'! Read here, see the top MSE parking forum thread 'PPC letters, what to expect' and ignore the whole lot of rubbishy debt collector 'scary letters' the desperate scammers throw at you:

And also read 'welcome, please read before posting' on that MSE forum, with its information and Watchdog link, near the top of that forum. And read ANY other thread on there you fancy looking at, which is about any private ticket. You will see the word 'IGNORE' is a common theme!

And for the poster who slagged off pepipoo forums, probably because you do not know about them? I will repeat, they get people off over 95% of Council (real) PCNs. They have lots of experience & info, do not knock it!

Council tickets (you WILL get off most tickets): FightBack Forums -> Council Parking Tickets Clamping and Decriminalised Notices

Private tickets (if me telling you to ignore it isn't enough, ask here): FightBack Forums -> Private Parking Tickets Clamping

And Watchdog are linked here, a solicitor's advice on private tickets (even if you have written and 'appealed' LOL, as if private parking scammers are going to allow appeals!):

And any private firms saying they have taken people to Court and won? Complete bollocks, almost unheard of except the odd undefended Small Claim won by default, or a set-up 'show case'.

Always ignore any private 'parking charge notice' = fake PCN. Commonly issued at Supermarkets, Dunelm Mill, B&Q, Homebase, ToysRUs, etc. Unenforceable rubbish.

You've got to laugh - I'm was up at Falmer to take a photograph of the stadium, because for the Hull match it was a perfect sunset evening. I've parked up the Falmer road in the gateway to the field. I'm aware of the signs saying no vehicles to be left unattended. I sat there for about an hour waiting for just the right light. Behind me parked on the verge is a silver Land Rover Defender who was parked there for about 45 minutes with driver sitting at the wheel. I presumed he was a snapper waiting for the light as well.
The light is right, I go into the field and walk approx 30 metres to take about a dozen images. I noticed the LandRover has now moved and parked by my car and then moved off. Ten minutes later I'm back at the car and Bingo! A parking ticket!
The poor sod had sat there all that time waiting for me to get out and take a photo. Bless.
Ok, it's cost me 35 quid but it's a great picture!!
Bizarrely, he didn't ticket the 4 other cars parked there who were obviously watching the match.....

Just to drag this thread away from 'ignore any private fake Parking Charge Notice' and back to the OP which I 'think' was a real Council Penalty Charge Notice (big difference), I found the info about wearing a uniform, which you will need to state clearly if you want to appeal - ONLY if it is a real PCN:


This quote from a thread on pepipoo forums, as a suggested appeal paragraph:



I am aware of the provision under section 76(3) of the Traffic Management Act 2004;

(3)Civil enforcement officers—
(a) when exercising specified functions must wear such uniform as may be determined by the enforcement authority in accordance with guidelines issued by the appropriate national authority, and
(b) must not exercise any of those functions when not in uniform.

The CEO was seen not to be wearing a uniform in compliance with section 76(3)(a) and with the guidance given in section 42 of the Secretary of State’s Statutory Guidance;

42. When exercising prescribed functions a CEO must wear a uniform. The
uniform should clearly show:
that the wearer is engaged in parking enforcement;
the name of the local authority/authorities of whose behalf s/he is acting;
and a personal identity number.

...blah...blah (whatever else you want to add)...finish by saying you understand the Council should now cancel this PCN or you will have no hesitation in taking the matter to adjudication.
