I would have thought the process would involve his lawyers being informed of the decision and they relayed the information onto Gus.

Maybe they didn't inform him in the appropriate manner and time.

To me it seems that the ones who dislike Gus are actually those giving him the most credit by saying he is some sort of PR genius and a good actor to boot.
