flag pole

i have recieved a letter from the local council , telling me that i have erected a flag pole in my garden. yes i did about 3 years ago, they are now telling me that i dont have planning permission to have it, and that i must remove the pole or they will and charge me for the pleasure, in my defence i didnt know that i needed planning permission to put a flag pole up in my garden, and secondly why tell me after about 3 years.
i think someone complained or a member of the local council is related to someone on ldc as the offending flag pole has a brighton & hove albion cross of st george on it.

so do i apply for planning permission or just give in and put the flag on a big stick and fly it off my shed .

as if they will be interested , i could say it will ruin an area of natural outstanding beauty if taken down
