And Huntley is just a rare example. What would the public prefer, a criminal justice system that imprisons people for a minor offences with little supporting evidence, or a more thorough and fair one where the occasional person unfortunately slips through the net.

Rape is a very diffidult case. More often than not, it is her/his word against his/her word. Proof and evidence can be very diffiult.

And in circumstances where the accused male is genuinely innocent and there is not sufficient evidence for a conviction and custodial sentence, then surely a caution protects him in this instance?

Also its not always as cut and dry as a statistic would suggest.

"Sometimes in those cases the victim just wants an admission from the defendant, but doesn't want a trial so that would result in a caution," she said.

A MAN convicted of a terrifying gang rape is helping to organise the British National Party's local election campaign in trouble-torn Oldham.

Robert Bennett, 59, is in charge of distributing the far-right group's leaflets in the town - scene of bloody race riots last summer - for the council elections.

What voters didn't know until today is that election co-ordinator Bennett was sentenced to five years in prison for his part in the rape of two 17-year-old girls. The incident happened when he lured the girls to a house with four other men claiming there was a party in progress. But the teenagers found they were the only guests, and they were forced into separate bedrooms and raped repeatedly.
