Done a bit of contract law.

Might not be your preferred choice but if the contract was agreed (price for goods) and now buyer wants to change the contract (price) you have the option of rejecting this and both of you must be put back in the position you started in. This will mean you have to re-sell your goods, but the buyer must return them to you at HIS cost (and in the same condition in which he took them away). You'll have to judge if this is a viable option, but if I were you and as mad and angry, I'd not let the fcuker get away with it.

Another angle, the Sale of Goods act does not cover the buyer if the goods are inspected and tested before closing the deal (agreeing the price) - good old Caveat Emptor rules in these purchases (buyer beware) - so if he has inspected the goods and taken them away, that is contract complete and he cannot (by law) withhold payment (PayPal aside you can sue him for breach of contract via the small claims court - you can also include in your claim all reasonable costs in bringing the claim). Wise man says - never sue a man of straw.

For the definitive, go talk to Citizens Advice Bureau - they will advise you.

Well the goods went for a little over £500, and that's a good deal of money to me these days.

I would have been happy with cash on collection obviously but he paid by PayPal and THEN told me he'd rather prefer to collect. I didn't argue because frankly I hate dealing with couriers and it sounded much safer to deal with the guy in person. Don't know why I thought that now.

Wrote him a very fair repsonse to his nonsense explaining that he was being a little out of order and that if he had a problem he should have brought it up at the time etc. and unsurprisingly I've heard nothing back.

The problem is I really NEEDED a quick sale and now this is going to drag on for ages.

I'll never bother with selling on eBay again

I've just gone through Small Claims court all online here:- http://www.moneyclaim.gov.uk and £80 later (which you claim back plus £0.65p per day interest) and then can send in Baliffs, have a hold over sale of their house, or get deductions from earnings..

Clearly you won't get that far, but it is pretty easy peasey to do.. :thumbsup:

theres alot of this going on now, one scam one stupid cow fell for was a Mercedes CSL, only saw photos of it and transfered 25k to the 'Alledged' sp seller, funny she never saw the car or the money

I'm afraid you're totally screwed.

PayPal will not give you the money if he raises a dispute.
They will only accept a proof of delivery receipt, which of course you don't have.

As has been mentioned, CASH only for collection items.

PayPal are complete shit heads.

I managed to get the money by issuing a partial refund of £15 which then seemed to release the rest of the money that was being held.

Not impressed I lost £15 of the money I should have been paid but it did at least mean that it was sorted out quicker than if it had gotten all messy with action being taken.
