Ebay and paypal buyer protection

Has anyone had any experience with this? In short, I won an auction on line, they posted it second class (and got proof of postage) on January 15th and I haven't received the item.

The seller is only prepared to refund half the value. In good faith, I can understand where they're coming from with this offer, but from my point of view I've handed over my money and received nothing for it.

However, I'm fairly sure that paypal comes with buyer protection which means I can get a full refund if I don't receive the item. Has anyone had experience with this?

Think once they have proof of postage your claim will be against the royal mail and the seller does not have to refund you.

Indeed vulture, I'd hope that the seller doesn't end up paying for a Royal Mail f*** up. But from the ebay site under paypal buyer protection:

If you and the seller can’t agree on a solution.
If after 10 days the problem can’t be resolved, let us know. We’ll arrange for a refund including original postage if your case qualifies for eBay Buyer Protection. Remember, eBay Buyer Protection only applies to items paid with PayPal.

I'm just wondering whether anyone has experienced this?

It's frightfully easy as a buyer to take the piss with this approach.

I work a lot with Paypal & eBay, if you put in a pay pal claim saying you have not received the item. They will need proof of delivery to your address, if the seller can't provide this then you will win the claim and get your money refunded in full.

Its upto the seller to claim then against Royal Mail for their loss.

The way I understand it is the seller needs to provide a Tracking number ie sent by recorded delivery etc. Proof of posting is not sufficient. You'll need to make a claim through ebay that you haven't received the item.

I use eBay all the time. I've never had any problems with this, just use the "Resolve a Problem" option in eBay, wait the appropriate time, and then they will instruct PayPal to issue a refund. Like I say, I have done it a few times, similarly, others have done it to me, which is why I now only sell using recorded/signed for delivery. I've not had a single claim against me since that I wasn't able to resovle to everyones satisfaction.

Totally agree, I sell more than buy on e-bay and everything is in the buyers favour. A receipt of postage is not good enough - I know that e-bay have refunded money to buyers (mainly in s-america) when they have probably got the package. But what can you do? you can't send everything international signed for at £10 a time.

I don't think I'd ever sell to South America or Africa to be honest.


Actually what does annoy me about ebay is that they insist paypal is made available for some items. Given what some are saying about buyers pisstaking, I don't think I'd want them to be able to use paypal in some cases!

Someone hacked into my eBay account before Christmas and listed dozens of Macbook's and iPads for sale. The person then got the winning bidders to transfer money into his bank account and not use paypal. Most people he sold to realised this was suspicious, but some paid the money. Anyhow, even then eBay refunded the money to the buyers who had been ripped off.

It sits very well. Luckily we're only talking about £18 or so.

Yes, yes I did. I had fully read up on buyer protection, although I was unaware of the £41 Royal Mail refund as Rowdey has posted.

I was actually more curious to know what sort of experience people using their buyer protection had previously seen.

As an ebay seller I always obtain Cetificate of Posting. If the item goes missing then I can make a claim of £41 against the Royal Mail.
As a gesture of goodwill I would refund the purchase price to the buyer and claim this amount from Royal Mail.
If the item is above £41 I would request the buyer to pay for Registered post
