Council Meeting - Wednesday

In a reply from Coucillor Ruth O'Keefe, I last week received this reply:

"In terms of your request for guidance on putting a question to the
Council meeting please be advised that a question may only be asked if
notice has been given by delivering it in writing or by electronic mail
to the Head of Democratic Services no later than midday two working days
before the meeting ie midday on Monday 5 December. Each question must
give the name and address of the questioner and the name of the
organisation they represent (if applicable) and must name the member of
Cabinet to whom it is to be put. If you wish to e-mail your
question(s), please send it to alan.batty@lewes.gov.uk"

As acoucil tax payer in lewes, I provided notice of the following question which i inteneded to put to Coucillor De Vecchi:

I understand that the District Council has approved the expenditure of
up to £25,000 to seek judicial review of the decision made by the Deputy
prime-minister to approve the location of a Community Stadium at Falmer.
Can the leader of the Council explain how the expenditure will be capped
at that level once legal proceedings are under way, given that if the
challenge is unsuccessful the Council will be liable to the Government's
own legal expenses as well as their own?

I have just received the following reply:

I write to acknowledge receipt of your e-mail which sets out a question for Public Question Time at the Council Meeting to be held on Wednesday, 7 December 2005.

Public Question Time will take place at the begining of the meeting which commences at 2.30pm. Please arrange to be present in the public gallery in the Chamber, Pelham House, St Andrew's Lane, Lewes at that time, when each questioner will be called upon in turn, in the order in which the questions have been received.

If you wish, you will be able to put one supplementary question relating to the answer given to your original question, following the reply by the Leader of the Council, Councillor De Vecchi.


However I now find that I need to be in London at the time of the meeting. I am therefore going to reluctantly withdraw my question. If there are other Lewes Residents who can attend and put a similar or other related questions then Mr Batty needs to be notified by midday today.

Procedure: Is the Decision of the Cabinet subject to confirmation by the Council Meeting to be held on 7 December?

No, the matter is not on the Council agenda for the meeting of 7 December and the application to the High Court will probably be lodged before the meeting of the Council. The Cabinet had full legal powers to take the decision to make the application to the High Court.



Bearing in mind the above, are we certain that questions will be allowed on a subject that is not on the agenda. Is this LDC trying to squirm out of facing public questioning again.:angry: :angry:

As I said I would have put the question below at 'public question time' - at 2.30 pm, but notice of the intended question needed to be provided by today:
