No matter how much they fix things there will always be things for people to fall over/in/out of.

Perhaps the councils would be better off buying shitloads of bubblewrap and wrapping everything...and everyone in it? but then they would probably get sued because it chaffes or squueks or something.

All the time theres humans wlaking the earth there will be the potential to hurt one self.

Its your own personal choice how you deal with it.

Ive missed a month of work, been in pain, been up and down the bloody hospital, been hobbling about on crutches which I can tell you is hard going......and the area I was walking is an accident waiting to happen and did happen.

Therefore I wish to make a claim. If in simular circumstances...you would let it go and not claim that would be upto you.

This claiming shit is bollocks. So if for example I tripped down a rabbit hole in Preston Park, I could sue Brighton & Hove City Council for not signing it? There's better things to spend taxpayers money on than scouring the country to correctly sign holes in fields. Next time look where you're going you dopey twat, you fell down a hole deal with it.:guitar:

Well, as I say, if its a public park then it'll be the council. If its a field then (presumably) it'll be the landowner/farmer.

You say the ditch was recently created, but then not signposted. Is it apparent that it was deliberately dug by someone ? Is there a purpose for it ? Is it a work in progress ?

That that you're under any obligation of course, but it'd just be interesting to know a bit more background to the claim you're looking to make.

I have had similar, on several ocassions. It goes with the job i do sometimes. And i've never sued. As you say its a personal decision.... I work with others who have claimed sometimes.

All i will say is.....Who ultimately pays? The guy who dug the whole? no. The park-keeper? no.

It will come out of our pockets ultimately. If everyone claimed, every time - we would need very deep pockets.

A mate of mine who is a cabbie heartily recommends claiming from insureres for whiplash injuries if you're rear-ended (ahem). Just say you're got back pains, it hurts to turn your head etc. One letter from a doctor and a few forms later, and a few grand will be winging its way to your account.

He's done it a couple of times now following a shunt. I'm always sure to thank him when my insurance is due.

so you're quite happy for YOUR money to be 'spunked' paying out to people who don't look where they are going?
as it is your money are you aware how much one of these claims costs?
lets say byf gets £5k i'd bet the 'Lawyer for you' gets £25k (someone who knows for a fact may well correct me) As far as I see it, a world without lawyers would be like a world without football agents

I think you will find I simply asked for a claim company that someone may have dealt with and found to be helpful.

Lets not confuse asking that for an opinion based rant at me about how im wating tax payers money or im a fcukwit or other insults.

the problem is, byf, people looking for a payout is the driver behind health and safety culture. one London council is having to cut down trees in a park to avoid people claiming for branches falling. shirley if a ditch was big enough to fall in and break a heel, its big enough to see with out 6 foot corden and fluorescent signs. presumably you'd like the pathway closed to public access to avoid future injury?

I hope that one day you dont fall over, trip over or have an accident that puts you out of work, out of leisure and in pain for 4-6 weeks or longer.

I hope that you dont have to go through the pain at night and the endless trips up A & E because you cant get a doctors appointment.

At the end of the day, youve obviously got morals, have never wronged anyone or any system or wasted tax payers money or ever left a shop when they have given you £5 extra change by mistake.

I bet you run your own charity raising millions a year for deprived children all around the world also.

You should be given the keys to the city by now surely.

In all seriousness though, i do understand what your saying but this appears to be a freshly dug hole on council property, with nothing to suggest its there - if that is the case then they should be sued.

If you were to slip in Tescos because they had cleaned the flooer and not put a sign down (smashing your heel in the process) would you not sue ?

Whats the different between that and byf's situation ?
