He'll definitely appeal. I am pretty uninformed but from what i have read its a rather dangerous verdict from the judge, by her own admission she cant remember what happened but hes ruled she was too drunk to consent on the strength of her stumbling on CCTV.

The judge also said that hes taken into account there was no force involved, she had no injuries and it wasn't premeditated or planned in any way...Rather scary thought for anyone taking home a girl on a night out that if she is deemed too drunk you could be waking up the next morning to 5 years in nick!

Just to qualify this post - Rape is a horrible thing and if hes genuinely guilty he should be punished.

But if she was too drunk to consent then arn`t they both guilty

exactly...which is why its such a dodgy verdict...its almost as if shes woken up and decided she would have shagged one but not the other.

only those that heard the case can know really but it does seem rather odd

Not really. McDonald's verdict took over five hours so it was very close. And I have read the girl came on to McDonald in the hotel room. The jury has to be sure "beyond all reasonable doubt" and this would have cast doubt on their thoughts regarding consent. She might not have been able to give consent but this could have been construed as consent by the defence. It's not clear hence not guilty.

I guess the same didn't happen for Evans.

Personally I think both should have gone down.

It's not really that dodgy. McDonald chatted her up at a bar and she went back to his hotel took with him. Evans appears to
Have turned up half way through and 'got involved'. Her behaviour going back to his would have implied some sort of consent in the juries eyes i guess. None of the same mitigating factors apply to Evans which is why he got guilty. He wont be getting off on appeal.

Like i said I dont know what happened but the things i have read about the case seem to leave an alarming amount of room for interpretation.

Take the resorts like malia, kavos, zante, magaluf etc. Girls and lads waking up in beds having had sex/3somes/whatever with very little memory is a daily occurrence during the high season. Where do we draw the line?

Also take into account that social pressures surrounding sexual promiscuity are different for men/women, which means that for alot of girls their attitude to sex is very different when drunk and uninhibited. She cant remember what happened...maybe she said or did things drunk she couldn't imagine doing sober...such as having a threesome with some footballers.

Presumably there is more evidence to the case as a mans life is on the line here and drunken stumbling on CCTV and waking up in a strange bed seems rather thin.

I was talking to an acquaintance of this girl last night (a friend of my daughter) and apparently this is not the first time she has made such a claim. She must be very unlucky.....

Given it took over 5 hours to clear McDonald yes.

Would the defence counsel and judge have been aware of that. If not why not or is it just hearsay.
