Car repaired by insurer, broken again - where do I stand?

Any idea where I stand on this...

Had a car crash in November - car coming towards me went into a spin and I piled into them. The passenger in the other car had, intelligently, pulled the handbrake.

Anyway, all their fault obviously. My car got picked up by my insurer and got taken to their local approved insurer. Took them 2 months or so to repair it - big wait for replacement airbag or something.

Anyway - have it back and a few little bits still wrong and the car runs out of power steering fluid. I top it back up - does no good so back it goes.

Get the car back, runs out of fluid again so back it goes. They sort it and give it back again.

That was probably about 6-8 weeks ago now. This evening, driving back from Sussex it happens again - power steering reservoir completely dry. About 2 weeks after I had the car back on the last occasion the insurers contacted me to see if I was happy with the repairs and I said "yes", as I was at the time.

I can't believe todays incident is unrelated. I now have to wait until Tuesday to speak to someone again - I want them to take the car back and try and fix it again, but they could say "no, it was all sorted." Any idea, anyone?

Take it back - 3 returns and eventually ours was sorted.

You have your rights (but don't gamble on them :lolol: )

Tell them that you are now, with the benefit of hindsight, unhappy with the repairs that were carried out. Tell them that you feel that the repair centre are incompetent (having been given multiple opportunities to fix the defect), and you want the car checked out by a third party, independent garage that specialises in your vehicle.

If they refuse, tell them that you would like the address of the insurance ombudsman, and you want the address of the Head of the Department who is responsible for allocating partner garages in your area. Tell them that you will also be contacting the Department of Transport regarding professional standards at the garage.

It seems that it may be a simple crack in the system, or a poorly replaced hose, but put the blame back at their door.

They have an obligation to make good your property be it house or car in the event of wilful or accidental damage caused by a third party. Therefore if your continuing problems are in your considered opinion as a result of this incident and your car had not displayed these problems prior to this, your insurer still has an obligation under your insurable interest to indemnify you i.e to put you back in the position you were in prior to the acccident.
